RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
REFERRING ED87-72
BACK TO THE PLANNING COMMISSION
FOR FINAL RESOLUTION OF
FINDINGS AND CONDITIONS
FOR BAYVIEW BUSINESS PARK BUILDING 'H'
WHEREAS, on September 27, 1988 the San Rafael Planning
Commission conditionally approved Environmental and Design Review
permit ED87-72 for Bayview Business Park Building 'H'; and
WHEREAS, on September 28, 1988 the applicant, Bayview
Associates, filed an appeal of the Planning Commission's conditional
approval; and
WHEREAS, such appeal has been held in abeyance at the request of
the applicant and agreement of the City pending the outcome of
discussions between the applicant and the Planning Department to
resolve the issues of the appeal; and
WHEREAS, there has been litigation pertaining to City's conditional
approval of Bayview Business Park buildings A, F and G involving similar
circumstances to that of Building H and the litigation has resulted in a
court ruling in favor of the applicant; and
WHEREAS, the Planning Department has consulted with the City
Attorney and has determined that the court's ruling would apply to
building 'H' as well;
NOW, THEREFORE, BE IT RESOLVED, that the City Council refers the
environmental/design review permit back to the Planning Commission
for final resolution of findings and conditions for building 'H' of Bayview
Business Park.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California,
HEREBY CERTIFY that the foregoing Resolution was duly and regularly
introduced and adopted at a Regular meeting of the Council of said
City held on the 15th day of May 1989, by the following
vote, to -wit:
AYES: Councilmembers= Boro, Breiner, Frugoli, Thayer & Mayor Mulryan
NOES: Councilmembers : None
ABSENT: Councilmembers : None
