RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ACCEPTING GRANT OF ACCESS EASEMENT
FOR MAINTENANCE OF DRAINAGE DITCH - LANDS OF
MAHONEY (A.P. NO. 18-142-20 & 21)
WHEREAS, the public interest, convenience, necessity and wel-
fare require that the grant of easement hereinafter mentioned be
accepted and used for the benefit of the public of the City of San
Rafael, California;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael, California, does hereby accept that certain grant
deed from JAMES D. AND MARGARET M. MAHONEY, dated May 10, 1989, for
and on behalf of the City of San Rafael, all as more particularly
described and set forth in the attachment hereto and incorporated
herein by reference, and the Clerk of said City is hereby directed to
cause said deed to be duly recorded in the Office of the County
Recorder of the County of Marin, State of California, forthwith upon
the adoption of this resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday, the 5th day of June, 1989, by the following vote, to
wit:

GRANT OF EASEMENT
This Grant of Easement is made as of the tenth day of May,
1989 by James D. Mahoney and Margaret M. Mahoney, husband and
wife (hereinafter referred to as "Grantors").
Grantors hereby grant and convey to the City of San Rafael,
a municipal corporation, a non-exclusive easement, twenty (20)
feet in width, over and across that certain real property owned
by Grantors and more particularly described in Exhibit "A" at-
tached hereto and incorporated herein by this reference, for the
purpose of providing pedestrian and vehicular access to the
drainage ditch which is located immediately to the southwest of
Grantors' real property for the maintenance and repair of said
drainage ditch.
IN WITNESS WHEREOF, Grantors have executed this Grant of
Easement as the date first above written.

EXHIBIT "A"
A non-exclusive pedestrian and vehicular access easement
twenty feet in width over and across the lands of James D.
and Margaret M. Mahoney, in San Rafael, Marin County, said
lands being described in the Director's Deed from the State
of California to Frank G. Merz, Jr., et al, recorded in Book
1562 at Page 352, Marin County Records, the centerline of
said easement being described as follows:
Beginning at the most northerly corner of said lands
(1562 O.R. 352), said point of beginning lying in the
southeasterly line of Simms Street and being the
intersection of the courses N W29'13" W 101.31 feet and
S 46023'18" W 116.10 feet, thence along said southeasterly
line S 46023'18" W 92.5 feet to the TRUE POINT OF BEGINNING;
thence from the true point of beginning and leaving said
southeasterly line and along said centerline the following
courses: S 40'40' E 41.0 feet, S 60054' E 96.5 feet,
S 74°17' E 82.0 feet and S 38°55' E 196.43 feet to the
southeasterly line of said lands (1562 O.R. 352), the
sidelines of said easement being prolonged to the boundary
of said lands.
