RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
DENYING THE APPEAL OF THE PLANNING COMMISSION'S
CONDITIONAL APPROVAL OF UP89-12,
40 -BED DRUG AND ALCOHOL REHABILITATION
FACILITY ON THE SITE OF THE "MARIN MANOR"
RETIREMENT FACILITY AT 603 "D" STREET
WHEREAS, a use permit application was submitted for the establishment of
a 40 bed alcohol and drug treatment center at 603 "D" Street; and
WHEREAS, the Planning Commission reviewed the proposed project at the
regular meeting of June 27, 1989, received the planning staff report
recommendation and public testimony and voted to approve said application; and
WHEREAS, the project approval was appealed to the City Council and the
City Council heard the matter at a duly noticed public hearing on July 17, 1989.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby
denies the appeal of the Planning Commission's approval of UP89-12 based on the
following findings:
1. Granting of this use permit for a 40 resident drug and alcohol treatment
facility will not be detrimental to the health, safety, or welfare of
the neighborhood or City in that the conditions of approval will
adequately monitor compliance with State requirements; adequate on-site
parking is provided with regard to the historical use of this location;
the present facility at 805 and 812 "D" Street has maintained a low
profile in the neighborhood and has not been an enforcement problem for
the City; and the City's share of such facilities in the County will not
be significantly increased. Additionally, the use is consistent with
the goals and policies of the San Rafael General Plan 2000.
2. Expansion of the program from the currently approved 33 residents
located at 805 and 812 "D" Street to 40 residents at 603 "D" Street, in
this particular case, would not be detrimental to the health, safety,
and welfare of persons in the neighborhood in that the Center Point
program has a proven successful track record in the field of drug and
alcohol abuse treatment.
BE IT FURTHER RESOLVED that the following conditions of approval shall
apply to UP89-12:
(a) This use permit approves a maximum 40 resident residential drug/alcohol
abuse treatment center at 603 "D" Street.
(b) This facility shall meet all Uniform Building Code standards to the
satisfaction of the Building Department and Fire Code requirements to
the satisfaction of the Fire Marshall at all times.
(c) Center Point residential treatment center shall maintain evidence of on-
going compliance with all State requirements for City review at all
times.
(d) Eight parking places shall be striped and maintained at all times.
Reserved spaces shall be provided for Center Point vans. Additionally,
no inoperable vehicles shall be stored in this parking area at any time.

(e) Landscaping shall be maintained in a healthy and thriving condition at
all times to the satisfaction of the Planning Department. Such
maintenance shall include regular watering, weeding, pruning and
replacement of dead or dying plants.
(f) All exterior lighting shall be maintained to the satisfaction of the
Police Department.
(g) Prior to occupancy a sign program shall be submitted for review and
approval by the Planning Department and all existing signs shall be
removed.
(h) Because of the lack of available on-site parking, automobile use by
residents shall be prohibited.
(i) Prior to occupancy, Center Point shall establish an outreach program
with the surrounding neighborhoods. A Center Point staff person shall
be designated as a contact person with the community to review questions
or comments from the neighborhood. The outreach program shall designate
a Gerstle Park resident as a member of the Center Point Board of
Directors.
(j) A permanent location shall be provided for the trash enclosure prior to
occupancy of the use and subject to Planning Department approval.
(k) House rules shall be adopted to limit noise to reasonable levels and
control loitering on public areas. These house rules shall consist of a
requirement that visitors are welcome by previous appointment only on
Saturday between 2 - 5 PM and on Sunday from 10 AM until 12 PM.
Unauthorized visitors are promptly asked to leave. Additionally,
residents of the program must be accounted for at all times. Written
requests must be submitted to staff by residents in order to leave the
premises, and residents must sign out upon leaving.
(1) Center Point shall establish and maintain a minimum staffing level to
provide safety and security during all shifts. The program requires
that 4 staff persons are on duty from 10 AM until 8 PM and 2 staff
persons on duty from 8 AM to 10 AM and 8 PM until midnight. One awake
night manager will be on the premises between the hours of midnight and
8 AM. The program rules and structure shall be known by all residents
and made available to visitors.
(m) This use permit shall be subject to yearly review by the Planning
Commission.

REGULAR meeting of the Council of said City on MONDAY , the 17th
