NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby denies the appeal of the Planning Commission's approval of UP89-12 based on the following findings: 1. Granting of this use permit for a 40 resident drug and alcohol treatment facility will not be detrimental to the health, safety, or welfare of the neighborhood or City in that the conditions of approval will adequately monitor compliance with State requirements; adequate on-site parking is provided with regard to the historical use of this location; the present facility at 805 and 812 "D" Street has maintained a low profile in the neighborhood and has not been an enforcement problem for the City; and the City's share of such facilities in the County will not be significantly increased. Additionally, the use is consistent with the goals and policies of the San Rafael General Plan 2000. 2. Expansion of the program from the currently approved 33 residents located at 805 and 812 "D" Street to 40 residents at 603 "D" Street, in this particular case, would not be detrimental to the health, safety, and welfare of persons in the neighborhood in that the Center Point program has a proven successful track record in the field of drug and alcohol abuse treatment. BE IT FURTHER RESOLVED that the following conditions of approval shall apply to UP89-12: (a) This use permit approves a maximum 40 resident residential drug/alcohol abuse treatment center at 603 "D" Street.
