HomeMy WebLinkAboutCC Resolution 8016 (Kaiser Hospital Use Permit)RESOLUTION NO. 8 016 OF THE SAN RAFAEL CITY COUNCIL DENYING APPEAL AND ACCEPTING REVISED CONDITIONS OF USE PERMIT FOR KAISER HOSPITAL [UP89-5] WHEREAS, a use permit application was submitted for expansion of Kaiser Hospital at 99 Montecillo Road; and WHEREAS, a Negative Declaration has been prepared in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, the Planning Commission held a duly noticed public hearing on May 9, 1989; and WHEREAS, the Planning Commission continued the public hearing to May 23, 1989 to review alternative circulation patterns for the lower parking lot; and WHEREAS, The Planning Commission considered all reports, letters, recommendations and testimony; and WHEREAS, on June 13, 1989, that the San Rafael Planning Commission unanimously approved use permit; and WHEREAS, on June 19, 1989, the Terra Linda Homeowners Association appealed the use permit based on building size and traffic/circulation issues; and WHEREAS, on August 7, 1989 the San Rafael City Council held a duly noticed Public Hearing on the appeal of the use permit; NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council hereby denies the appeal and approves the use permit based on the following findings and the conditions contained in Exhibit A: Negative Declaration Certification of a Negative Declaration for the Kaiser Hospital Master Plan is consistent with the California Environmental Quality Act because all potential environmental Impacts will be mitigated by project design. Further, traffic, circulation and parking concerns have been addressed under the Priority Projects Procedure and parking studies performed for this specific site. Building mass, views and neighborhood compatability have been improved through review and redesign of the master plan. UP89-5 1. Denial of the appeal is justified because the project's circulation impacts have been mitigated through conditions of approval. Kaiser will be responsible for striping a left turn lane and painting of a red curb in the vicinity of the project. Additionally, traffic mitigation 1 n. P, " U � �1� 1.1 " L 'ri. I ft INA fees will be used to implement area wide traffic and circulation improvements. Furthermore, denial of the appeal is justified in that the use permit will approve a building envelope rather than a building footprint. The building envelope will encourage flexibility in design of the structure. Finally, the design of the Medical Office Building and the parking and circulation surrounding the building will be reviewed by the Design Review Board and Planning Commission. Final approval of the building and circulation will be approved by the City Council. 2. The uses proposed in the Kaiser Hospital Master plan are consistent with the proposed PD zoning, the San Rafael Zoning Ordinance, the Northgate Activity Center Plan, and consistent with the goals and policies of the General Plan 2000. 3. The establishment, maintenance and operation of the medical offices, hospital and service/storage building and parking facilities will not under the circumstances of this particular case be detrimental to the health, safety, peace, morals, comfort and general welfare of persons in the neighborhood nor would such proposed use be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City because the proposed uses are consistent with the zoning and General Plan in that the uses are properly related to other land uses and transportation facilities in the vicinity and because as conditions of approval mitigate traffic concerns through the implementation and ongoing review of a Transportation Systems Management (TSM) program. 4. The use of a Transportation Systems Management program is consistent with the requirements of General Plan Circulation policy C-22 and will assist in the maintenance of Level of Service conditions established under General Plan policies C-1 and C-2. Additionally, the TSM program will assure that impacts related to on -street parking are minimized. I, JEANNE M. LEONCINI Clerk of the City of San Rafael 2 EXHIBIT A CONDITIONS OF APPROVAL Fire Deoartment (a) A hazardous materials permit is required for the business to operate. The hazardous materials business plan must be submitted on the approved forms provided by the Fire Department and submitted to the Fire Prevention Bureau with the permit application, prior to occupancy. (b) A special Fire Department permit is required to be obtained based on the specific use or conditions created by the type of occupancy. This permit application is required to be submitted and reviewed prior to occupancy. Planning apaDIDent (c) This action conceptually approves Phase I development as depicted on the master plan prepared by A.K. Strotz & Associates and presented to the City Council on August 7, 1989 which include a 35,000 s.f. Medical Office building, a 6,800 s.f. addition to the Service -Storage building and a 312 stall parking structure. It further incorporates the previous approvals of a 78,957 s.f Hospital, and a 111,085 s.f medical office building. (d) Upon completion of the 35,000 s.f. medical office building all temporary buildings/trailers shall be removed from the site and the uses incorporated into permanent buildings. (e) An Environmental and Design Review permit shall be required for the Medical Office building, Service/Storage building and the Parking Structure. The permit for the Medical Office building and the parking and circulation plan for the lower lot, adjacent to the Medical Office building shall be reviewed by the Design Review Board and Planning Commission, and approved by the City Council prior to the issuance of building permits. (f) This use permit is contingent upon all conditions as specified under accompanying action Z89-2. (g) The use of the existing and proposed Medical Office buildings are contingent upon continued and effective implementation of a Transportation Systems Management (TSM) program. Prior to the issuance of a buildina hermit Kaiser Hospital or subsequent operator shall be responsible for the designation of a Transportation Systems Management Manager for the Hospital campus and shall submit a request for use permit amendment for a TSM program. The Zoning Administrator and the City Traffic Engineer shall review the TSM program every six months for a period of two years from completion of the Medical Office Building. Thereafter, the TSM program review period may be extended to an annual review if traffic level of service are within exceptable levels and TSM program results are above the City average. The property owner/TSM manager shall submit those materials deemed necessary for analysis of the TSM program. (h) Prior to issuance of a building permit the applicant shall pay traffic mitigation fee of $178,145 (in 1986 dollars). The amount shall be adjusted at the time of payment by the Lee Saylor Construction Cost Index since September, 1986. This fee is based on adopted fees of $2255 per PM peak hour trip in September 1986 dollars x 79 trips. 3 (i} A masonry wall shall be installed between the residences and the Kaiser parking lot at the time the parking lots are connected. Details for the wall shall be presented along with plans for design review of the proposed two story Medical Office Building or an independent design review permit and shall be evaluated by the Design Review Board prior to Planning Commission approval. (j) The curb along west side of Nova Albion Way and the south side Montecillo Road between the driveway cuts shall be painted red. (k) A left turn lane shall be striped to the satisfaction of the City Traffic Engineer on Montecillo Road at Nova Albion Way. (1) The parking lot shall be marked/painted with appropriate directional signs/arrows for ingress and egress. This shall be done to the satisfaction of the Traffic Engineer prior to Building Department final inspection. (m) This use permit shall be valid with the concurrent rezoning application for a period of 18 months from City Council adoption. The use permit for the proposed Medical Office building is contingent upon approval of an Environmental Design Review permit by the City Council. The use permit shall expire unless a building permit is issued for phase I development or a time extension is granted. 4
