HomeMy WebLinkAboutCC Resolution 8017 (Kaiser Hospital Campus)RESOLUTION NO. 8017 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CERTIFYING A NEGATIVE DECLARATION FOR AN ORDINANCE TO AMEND TITLE 14 (ZONING) OF THE MUNICIPAL CODE FOR REZONING OF PROPERTY LOCATED AT 99 MONTECILLO ROAD TO P D (PLANNED DEVELOPMENT) DISTRICT FOR DEVELOPMENT OF THE KAISER HOSPITAL CAMPUS [Z89-2] WHEREAS, a zone change application was submitted for expansion of Kaiser Hospital at 99 Montecillo Road; and WHEREAS, a Negative Declaration has been prepared in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, the Planning Commission held a duly noticed public hearing on May 9, 1989; and WHEREAS, the Planning Commission continued the public hearing to May 23, 1989 to review alternative circulation patterns for the lower parking lot; and WHEREAS, The Planning Commission considered all reports, letters recommendations and testimony; and WHEREAS, on June 13, 1989, that the San Rafael Planning Commission found that the Master Plan would not create any significant adverse impacts and unanimously recommended the certification of a Negative Declaration and conditional approval of the zone change application; and WHEREAS, on August 7, 1989 the San Rafael City Council held a duly noticed Public Hearing on the zone change application; NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council finds there is no substantial evidence in the record showing that the project may have a significant effect on the environment and certifies the Negative Declaration for an Ordinance to amend Title 14 (Zoning) of the Municipal Code by rezoning the subject property to a Planned Development District based on the following findings and the conditions contained in Exhibit A: Negative Declaration Certification of a Negative Declaration for the Kaiser Hospital Master Plan is consistent with the California Environmental Quality Act because all potential environmental impacts will be mitigated by project design. Further, traffic, circulation and parking concerns have been addressed under the Priority Projects Procedure and parking studies performed for this specific site. Building mass, views and neighborhood compatibility have been improved through review and redesign of the master plan. OR I Un � � A[ Z89-2 1. The proposed zone change for the Kaiser Master Plan area is consistent with the San Rafael General Plan 2000. The project is consistent with the General Plan: land use designation of Office, intensity of development allowed in the Northgate area, Circulation, and Safety policies as mitigated by the conditions of approval. 2. The proposed zone change would not be detrimental to the health, safety, or general welfare of the surrounding community or the City of San Rafael as a whole in that the uses permitted under the zoning are subject to review and approval of use permit which regulates the traffic impacts through a Transportation Systems Management Program reviewed annually after adoption and as other potential impacts are mitigated to insignificance through conditions of approval of other related development entitlements. LEONCINI Clerk of the City of San Rafael 2 CONDITIONS EXHIBIT A OF APPROVAL (a) The following zoning is Z89-2 approved: 1. Lana usa: -Hospital and Medical Offices 2. PM Peak Trip5: -100 PM peak hour trips are allocated for new development. 3. Parte: -A minimum of 780 parking spaces shall be provided. 4. Area: -25.81 Acres (1,124,284 s.f.) 5. JBuildinq Setbacks: -15 feet minimum front and side yards -30 feet minimum rear yard. A building envelope for the construction of the new 35,000 s.f. Medical Office building is established and is attached to the City Council Staff Report dated August 7, 1989 -Exhibit E. 6. Building Heights: -2 stories for all buildings constructed after the July 18, 1988 General Plan 2000 adoption. Permits existing 5 -story Hospital and Medical Office buildings. 7. Coverage: -.30 FAR (Floor Area Ratio) for buildings further limited by PM peak hour trip allocation of 100 trips. -Minimum 40 percent landscape coverage. 8. RoadwavA: -All roadways shall be at least 20 feet wide, unobstructed and be able to support a gross vehicle weight of not less than 35,000 lbs./single axle. Turning radius shall be not less than 35 feet. All roadways shall have an all weather surface and be installed prior to building permits being issued. (b) In accordance with section 14.51.070 of the San Rafael Zoning Ordinance the proposed Kaiser Master Plan zoning shall be valid for 18 months from City Council adoption. The zoning shall expire unless a building permit is issued for phase I development or a time extension is granted. After phase I is complete the zoning shall remain in full force and effect unless amended. 3
