RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL TO ENTER INTO AN AGREEMENT WITH
PACIFIC GAS AND ELECTRIC COMPANY FOR THE
INSTALLATION OF UNDERGROUND FACILITIES IN SAN
RAFAEL (INSTALLATION OF STREET LIGHTING SYSTEM
WITHIN LINDARO RULE 20A UNDERGROUND DISTRICT)
(IN AMOUNT OF $30,000)
WHEREAS, the City Council of the City of San Rafael adopted
Resolution No. 7660 establishing an underground utility district in
the vicinity of Third Street, Lincoln Avenue, San Rafael Creek and
Lindaro Street ("Underground Utility District") pursuant to Ordinance
905 of the City of San Rafael; and
WHEREAS, the City Council of the City of San Rafael has
ordered the removal of all poles, overhead wires and associated overhead
structures and the underground installation of wires and facilities
for supplying electric, communication, or similar or associated service
within the Underground Utility District on or before May 1, 1989; and
WHEREAS, the City Council of the City of San Rafael has
determined that the creation of the Underground Utility District is
in the general public interest; and
WHEREAS, Pacific Gas and Electric Company, a California
corporation (PG&E) has agreed to enter into an Agreement to install
facilities ("Agreement"), a copy of which is attached to this Resolution
as Exhibit "A", with the City of San Rafael, a municipal corporation,
in which PG&E agrees to provide necessary trenching, backfilling, excava-
tion and trench relocation for the street light and traffic signal
interconnect system within the Underground Utility District; and
WHEREAS, the San Rafael Redevelopment Agency of the City
of San Rafael, a public body, corporate and politic ("Agency") has
agreed to provide the funds for the PG&E work within the Utility
Underground District.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael that the City shall enter into the Agreement with
PG&E.
BE IT FURTHER RESOLVED that the Director of Public Works
be and hereby is authorized to execute the Agreement on behalf of the
City; and
BE IT FURTHER RESOLVED that the Director of Public Works
be and hereby is authorized to take any and all such actions as may
be necessary to accomplish the purposes of this Resolution and of the
Agreement.

regularly introduced and adopted at a regular meeting of the Council
of said City held on the 6th day of February, 1989, by the following

hereinafter called Applicant, has requested Pacific Gas and Electric Company, hereinafter called PGandE, to
perform the work described below at or near Lincoln, Li ndaro, Ritter 2nd & 3rd Streets
in the Citv of San Ra_fa_el
County of Marin State of California.
PGandE will perform the work and furnish all necessary labor, appliances, materials and facilities re-
quired, subject to the following conditions:
I. The required work shall be as follows:
(Describe in detail the materials and facilities to be furnished andior work to be done. For each facility installed, specifically indicate
whether ownership shall vest in PGandE or Applicant upon completion of work. If more space is required use other side and
attach any necessary drawings.)
PGandE will provide the necessary trenching, backfilling, excavation, and
trench restoration for the applicants street light and traffic signal
interconnect system as outlined on PGandE's composite drawings.
Any addition or modification, other than at the request of PGandE will be
at the expense of the applicant.
2. Whenever part or all of the required work is to be furnished or performed upon property other than
that of Applicant, Applicant shall first procure from the owners thereof all rights of way and/or permits
necessary in a form satisfactory to PGandE and without cost to it.
3. Applicant shall immediately, upon demand andprior to construction by PGandE, pay to PGandE
as the complete contract price the sum of Thi rty-thousand and 00/100------------------
