HomeMy WebLinkAboutCC Resolution 7899 (Underground Facilities)RESOLUTION NO. 7899 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL TO ENTER INTO AN AGREEMENT WITH PG&E TO CONVERT OVERHEAD ELECTRIC DISTRIBUTION TO UNDERGROUND (IN AMOUNT OF $258,723) MONTECITO RULE 20B UNDERGROUND DISTRICT WHEREAS, the City Council of the City of San Rafael adopted Resolution No. 7801 establishing an underground utility district in the vicinity of the Montecito Shopping Center, San Rafael Creek, Grand Avenue and Second Street ("Underground Utility District") pursuant to Ordinance No. 905 of the City of San Rafael; and WHEREAS, The City Council of the City of San Rafael has ordered the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within the Underground Utility District on or before August 1, 1989; and WHEREAS, the City Council of the City of San Rafael has determined that the creation of the Underground Utility District is in the general public interest; and WHEREAS, Pacific Gas & Electric Company, a California corporation, ("PG&E") has agreed to enter into an Agreement to Install Facilities, ("Agreement"), a copy of which is attached herewith as Attachment "A", with the City of San Rafael, a municipal corporation, in which PG&E agrees to convert overhead electric distribution facilities to underground within the boundaries of the Underground Utility District; and WHEREAS, the Redevelopment Agency of the City of San Rafael at their meeting of March 21, 1988 agreed to provide the funds necessary to accomplish the undergrounding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael that the City agrees to enter into the Agreement; and BE IT FURTHER RESOLVED by the City that the Director of Public Works be and hereby is authorized to execute the Agreement sub- stantially in the form attached as Attachment "A" to this resolution on behalf of the City with any minor changes that the Director of Public 7oFf9 Works in his discretion may approve; and BE IT FURTHER RESOLVED by the City that the Director of Public Works or the Director of Public Works' designee be and hereby is authorized to enter all agreement and take such actions as are necessary and reasonable to carry out this Resolution and the Agreement. Or[Rs AGREEMENT TO INSTALL FACILITIES DISTRICT OR PERFORM OTHER WORK City of San Rafael, a Political Subdivision of the State of California hereinafter called Applicant, has requested Pacific Gas and Electric Company hereinafter called PGandE, to perform the work described below at or near Monteci to Plaza, Znd ttreet between Irwin and Grand including the intersection, County of Marin , State of California. PGandE will perform the work and furnish all necessary labor, appliances, materials and facilities re- quired, subject to the following conditions: 1. The required work shall be as follows: (Describe in detail the materials and facilities to be furnished and/or work to be done. For each facility installed, specifically indicate whether ownership shall vest in PGandE or Applicant upon completion of work. if more space is required use other side and attach any necessary drawings.) *SEE ATTACHED EXHIBIT A The costs quoted do not include the costs, if any, for the alteration, removal, or rearrangement of any facilities belonging to any party other than PGandE. Seller shall be directly responsible to any third party(s) for payment of any additional costs incurred by such third party(s) in order, to complete the interconnection of Seller's project. Such costs may include, for example, installation of telephone lines and removal of poles with telephone cable solely attached to them. UPON COMPLETION OF WORK, OWNERSHIP OF ABOVE FACILITIES SHALL VEST IN PGandE. 2. Whenever part or all of the required work is to be furnished or performed upon property other than that of Applicant. Applicant shall first procure from the owners thereof all rights of way and/or permits necessary in a form satisfactory to PGandE and without cost to it. 3 Applicant shall immediately, upon demand andprior to construction by PGandE, pay to PGandE as the complete contract rice the sum of Two hundred fifty-eight thousand Seven Hundred twenty-three and 0 /100 ---------------- ---✓ ------j- dollars (S 258,723.00 �. Removal of 18 poles, 1995 feet of overhead conductor and 5 streetlights. Install 478 feet of new distribution (22 KV) cable in new 6" conduit. Install 4,076 feet of new distribution cable in 4" conduit. Install 1,040 feet of various size secondary service cable in new conduit (to various buildings within District). Remove all overhead transformers and replace with comparable sized under- ground -fed transformers. Total Rule 20B Costs..............................................$258,723 (CIAC Tax Exempt)
