RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL (IN ITS CAPACITY AS THE BOARD
OF APPEALS) DENYING APPROVAL OF AN APPEAL
FROM CHAPTER 35 OF THE UNIFORM BUILDING CODE
AT 1015 SECOND STREET
(RE SOUND TRANSMISSION REQUIREMENTS)
(NEW JERUSALEM CHURCH)
WHEREAS, the City Council of the City of San Rafael,
may serve as the Board of Appeals pursuant to Section 12.12.020 of
the Municipal Code, to hear appeals of the Uniform Building Code,
and
WHEREAS, the applicant for 1015 Second Street has appealed
Chapter 35 of the Building Code before the City Council, acting as
the Board of Appeals, and
WHEREAS, following a noticed hearing in which said appli-
cant was given full opportunity to be heard, the City Council, acting
as the Board of Appeals, does hereby find as follows:
1) That the appeal is denied and that plans for sound
insulation must be submitted within 15 days and construction completed
within 45 days from March 20, 1989 for the following reasons:
2) That Chapter 35 of the Uniform Building Code requires
the installation of sound insulation;
3) That sound from the New Jerusalem Church can be heard
in the residential units in the building above the church space;
4) That the level of this noise is intrusive on the
lives and objectionable to the residents living on the second floor
of the building the Church has occupied.
NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY
COUNCIL, ACTING IN ITS CAPACITY AS BOARD OF APPEALS, that in view
of the foregoing findings, the appeal for relief from Chapter 35
of the Uniform Building Code at 1015 Second Street, be and is hereby
denied.
