A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The CITY MANAGER, DIRECTOR OF PUBLIC WORKS and ASSISTANT
DIRECTOR OF PUBLIC WORKS are authorized to execute, on behalf of the
City of San Rafael, a contract, lease or agreement with
UNITED STATES ARMY (CORPS OF ENGINEERS) ENTITLED "AMENDMENT ONE OF THE
GENERAL INVESTIGATIONS, FLOOD CONTROL STUDY, FEASIBILITY PHASE"
a copy of which is hereby attached and by this reference made a part
hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the City Council of
said City held on Monday the 3rd day of April, 1989, by the following
vote, to wit:

We are writing in regard to the Feasibility Cost -Sharing Agreement
(FCSA) for the San Rafael Canal investigation. As previously discussed
between you arra my staff, additional information and issues which have
been identified since initiation of the feasibility study require that the
FCSA be amended. We have drafted an to the FCSA for the City's
review and approval. After the cutv=,,G, =aiL has been authorized by the City
Council and the Corps' South Pacific Division, the amendment will be
referred to the study's Executive Cc=lttee for approval.
The revisions to the Scope of Services are as follows:
Social Studies - This task will be reduced by $14,000 because the
Corps of Engineers' actual costs for conducting the scoping meeting were
lower than anticipated.
Environmental Studies - An Endangered Species Biological Assessment
will be added as a new task at an estimated cost of $14,000. The current
Scope of Services does not include funds for addressing impacts on
endangered species.
Fish and Wildlife Studies - The estimated cost of the Habitat Study
will be increased by $40,000. The current Scope of Services assumes that
the necessary field studies will be conducted under contract to the Corps;
however, the Corps of Engineers is bound by an aye.,=,t with the U.S.
Fish and Wildlife Service to allow the Service to conduct any biological
field studies and to provide funds to the Service for those studies.
Also, the current scope does not include funds for conducting the
quantitative habitat evaluation which is needed to determine mitigation
Economic Studies - The estimated cost for this task will be increased
by $5,000 to fund scoping and review of the City's economic inventory by
Corps staff.
Survey and Mapping - A Condition Survey will be added as a new task at
an estimated cost of $12,000. The current Scope of Services does not
include funds for evaluating the condition of the existing floodwalls and
etnbaNanents along the San Rafael Canal.

Hydrology and Hydraulic Investigation - Zhe estimated cost for the
Hydraulics task will be increased by $5,000 to fund analysis of surge
effects in the upper end of the San Rafael Canal. A Siltation Study will
be added as a new task at an estimated cost of $35,000. The current Scope
of Services does not include funds for determining the effects of the
tidegate alternatives on siltation and scouring patterns.
Study Management - The estimated cost for this task will be increased
by $4,000 to fund mars==.,- of new tasks.
Washington D.C. Level Review Contingency - The estimated cost for this
task will be increased $3,000 so that it will remain approximately five
per centum of the other study costs as specified by Article I of the
FCSA. The credit for Local Sponsor in-kind work will be increased by
$1,500 so that it remains half of the total.

request, a meeting of the Study Management Team or the Executive Comittee

Habitat Study - Pursuant to the Fish and Wildlife
Coordination Act, funds will be transferred to the
U.S. Fish and Wildlife Service to conduct field
investigations to determine existing habitat
conditions in the study area, identify mitigation
measures, perform a Habitat Evaluation Procedure to
quantify project impacts, and r1=pc"= draft and
final Coordination Act Reports. Corps staff will
coordinate the FPS activities and assist in the
field studies arra HEP.
