HomeMy WebLinkAboutCC Resolution 7962 (Sun Valley Open Space Annexation)RESOLUTION NO. 7962 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE ANNEXATION OF PORTIONS OF SUN VALLEY OPEN SPACE WHEREAS, the City of San Rafael desires to initiate proceedings pursuant to the Cortese -Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the annexation of portions of Sun Valley Open Space; and WHEREAS, the territory proposed to be annexed is uninhabi- ted, and a description of the boundaries of the territory is set forth in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the sphere of influence of the City of San Rafael; and WHEREAS, the reasons for this proposed annexation are as follows: 1) The parcels to be annexed are within the Sun Valley Open Space Assessment District. 2) Said Assessment District was formed and administered by the City of San Rafael. 3) Said parcels were acquired from the sale of Assessment District bond proceeds. 4) Assessments have been levied against all properties within the Assessment District in the City of San Rafael to pay off the bonds. NOW, THEREFORE, this Resolution of Application is hereby adopted and approved by the City Council of the City of San Rafael, and the Local Agency Formation Commission of Marin County is hereby requested to take proceedings for the annexation of territory as described in Exhibit "A" and in the manner provided by the Cortese -Knox Local Government Reorganization Act of 1985. LEONCIN , City Clerk EXHIBIT A SUN VALLEY OPEN SPACE ANNEXATION to the CITY of SAN RAFAEL APRIL 1989 All that certain- real property situated in the County of Marin, State of California, described as follows: Beginning at the most northerly corner of that certain deed from Emma Duca, a widow, to the Board of Education of the City of San Rafael, Governing Board of San Rafael School District of Marin County, California, a political subdivision, recorded December 29, 1950 in Book 679 at page 44, Official Records of Marin County, said point also being on the San Rafael City Limit Line, running thence North 32` West 520 feet, more or less, to the easterly corner of that certain parcel of land conveyed to Joseph Corti, et ux, in that certain deed recorded October 15, 1917 in Book 192 of Deeds at page 147, Official Records of Marin County; thence running along the San Rafael City Limit Line, also being the exterior line of said Corti parcel, to the point of intersection with the Southeasterly boundary of that certain parcel known as the Mount Tamalpais Cemetery; thence leaving said San Rafael City Limit Line North 3423'East 362 feet, more or less, to the northeasterly corner of said Mt. Tamalpais Cemetery parcel; thence along the northerly boundary of said Mt. Tamalpais Cemetery, also being the southerly boundary of that certain real property conveyed to the Marin County Open Space District and the City of San Rafael in that Corporation Grant Deed recorded December 21, 1984 in Serial No. 84- 058753, Official Records of Marin County, North 56" West 799.1 feet; thence South 7644' West 970 feet to a point on the boundary of Rancho San Pedro Santa Margarita y Las Gallinas; thence along the boundary of said rancho North 11'15' East 1402.2 feet to the San Rafael City Limit Line.
