RESOLUTION ORDERING CLOSING, ABANDONING AND
VACATING 15' WIDE DRAINAGE EASEMENT IN EAST
SAN RAFAEL (A.P. NO. 9-290-16)
WHEREAS, the City Council of the City of San Rafael
on the 18th day of July, 1988, adopted Resolution No. 7767 entitled,
"RESOLUTION OF INTENTION TO VACATE DRAINAGE EASEMENT IN EAST SAN
RAFAEL, PART OF KERNER BOULEVARD ASSESSMENT DISTRICT, A.P. NO.
9-290-16 (HELIPORT SITE)"; and
WHEREAS, said Resolution was posted as required by law;
and
WHEREAS, the Department of Public Works of the City
of San Rafael, California, conspicuously posted notices of easement
vacation as required by law; and
WHERAS, a hearing was had this day as required by law
and said Resolution No. 7767 , at which hearing the Council of the
City of San Rafael heard evidence offered by persons interested;
and
WHEREAS, it appears from all of the evidence submitted
that the following described easement is unnecessary for present
or prospective public use.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of San Rafael as follows:
1. That the following described easement is unnecessary
for present or prospective public use;
2. That the following described easement is hereby
ordered closed, abandoned and vacated;
3. That the easement closed, abandoned and vacated
is described on Exhibit "A" which is attached hereto and incorporated
herein by reference.
I, JEANNE M. LEONCINI, Clerk of the City of San
Rafael, California, hereby certify that the foregoing resolution
was duly and regularly introduced and adopted at a regular meeting
of the Council of said City held on the 15th day of August, 1988,
by the following vote, to wit:
AYES: COUNCILMEMBERS: Boro, Breiner, Frugoli, Thayer & Mayor Mulryan
NOES: COUNCILMEMBERS: None

EXHIBIT "A"
AN EASEMENT for drainage purposes located in the City of San
Rafael, County of Marin, State of California described as
follows:
BEGINNING at the most Northerly corner of the parcel described in
the Deed from Michael J. Scotto, et ux, to Robert W. Parnow, et
al, recorded August 4, 1958 in Book 1207 of Official Records at
page 211-B, Marin County Records; running thence along the
Northeasterly line of said parcel South 51° 14' 00" East 100.00
feet to the Easterly corner thereof; running thence along the
Southeasterly line of said parcel South 38° 46' 00" West 15.00
feet; thence leaving said Southeasterly line and running North 51°
14' 00" West 100.00 feet to the Northwesterly line of said
parcel; running thence along said Northwesterly line North 38"
46' 00" East 15.00 feet to the point of the beginning.
