RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
UPHOLDING PLANNING COMMISSION CONDITIONAL APPROVAL
OF ED 87-112, APPROVAL OF
ADDITIONAL UNIT ON R-3 LOT WITH NEW PARKING
AT 279 UNION STREET, WITH AMENDED CONDITIONS
WHEREAS, the San Rafael Planning Commission considered
ED87-112 on February 23, 1988 and referred the matter to staff
for additional information; and
WHEREAS, the Planning Commission further considered
the matter on May 10, 1988, and unanimously approved the project
with numerous conditions; and
WHEREAS, the matter was then appealed to the City
Council and the City Council heard the matter at duly noticed
public hearings on July 18 and August 15, 1988.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council hereby denies the appeal of the Planning Commission
conditional approval of an additional unit on an R-3 lot with
new parking at 279 Union Street and amends the conditions of
approval with findings as follows:
(1) The proposed additional dwelling unit is consistent
with the San Rafael General Plan 2000 land use designation
for the site and is appropriate with the R-3 zoning
regulations.
(2) The proposed additional dwelling unit, as conditioned,
will not be detrimental to the health, safety and
general welfare nor injurious to persons or property
in the vicinity in that adequate parking would be
provided, improved landscaping is required, automatic
garage rollup doors are required so that garages
can be safely and conveniently used with minimal
effect on Union Street traffic, and due to modifications
made to the proposed freestanding third unit so as
to improve its relationship to the adjacent property.
BE IT FURTHER RESOLVED that ED87-112 is approved
with the following conditions:
FIRE DEPARTMENT
(a) The proposed dwelling unit shall be equipped with a residential
fire sprinkler system per HFPA Standard 13D.
(b) The fire hydrant nearest to the property on Union Street
shall be upgraded to a type Jones 3740. Old hydrant shall
be returned to the San Rafael City Fire department.
(c) Addresses for the three units shall be posted per Fire
Department Standard 205.
(d) Bedroom windows shall comply with the emergency egress
requirements of UBC Chapter 12.
(e) All three dwelling units shall be equipped with a UL
approved smoke detector.
PUBLIC WORKS
(f) Building plans shall show all existing and proposed sewer
connections.

PLANNING DEPARTMENT
(g) Prior to occupancy, the driveway parking area shall be
modified as shown on the attached site plan to satisfy
City standard parking stall length and back-up aisle requirements.
(h) The site shall be maintained free of weeds, trash and
debris. All landscaping shall be maintained in a healthy
growing condition. Such maintenance shall include regular
watering, trimming, pruning, mowing and replacement of
dead or dying plants.
(i) A complete landscape plan for the site shall be approved
by staff prior to the issuance of building permits for
the project. Existing conditions in the rear yard shall
be improved to provide quality outdoor space for the tenants
of all three units. The plan shall also include an all
weather surfaced pathway from the proposed parking area
to the new unit. This path shall be lighted at 1/2 candle
power per Police Department requirements. The landscaping
to the rear of the proposed freestanding third unit shall
be maximized to provide additional buffer between the
subject and adjacent sites.
(j) Prior to issuance of a building permit, plans for all
exterior or roof mounted equipment on the new unit shall
be approved by the Planning Department, then painted to
match exterior colors as appropriate.
(k) Automatic remote controlled garage doors shall be installed
in both existing garages on the site. The automatic remote
controlled garage doors on the freestanding garage shall
roll up to minimize interference with the sidewalk and
adjacent street. These garage spaces as well as those
in the existing detached garage shall be maintained free
of any blockage which would preclude their use for the
parking of vehicles. The City reserves the right to make
periodic inspections to ensure that this conditon is being
met.
(1) Colors used in the construction of the proposed unit shall
match the existing duplex.
(m) Exterior siding shall be a horizontal lapboard variety,
subject to staff approval.
(n) Composition roofing materials shall be an architectural
grade thick butt variety and shall be subject to staff
approval. The freestanding shed in the back yard shall
be reroofed with materials to match.
(o) Fencing and/or landscaping shall be provided so the fifth
parking place between the two garage areas is not visible
through the lot from the adjacent property.
(p) This design review approval is valid for a period of one
year or until September 6. 1989, and shall thereafter
expire unless extended by the Zoning Administrator or
a building permit is issued.
