RESOLUTION NO. 7816
RESOLUTION GRANTING WAIVER OF THE BID PROCEDURE
AND AUTHORIZING PURCHASE OF A PORTABLE RESTROOM
BUILDING FOR THE PICKLEWEED PARK CHILD CARE CENTER
WHEREAS, the City Council awarded a contract on July 18,
1988, to Maggiora & Ghilotti, Inc., for Pickleweed Park Improve-
ments to include site preparation for the Pickleweed Child Care
Center and Community Garden and installation of a pre -fabricated
restroom building; and
WHEREAS, Maggiora & Ghilotti, Inc., has requested a time
extension to the September 26, 1988 contract completion date to
allow for a late October delivery of the restroom facility; and
WHEREAS, the restroom facility plans supplied by Maggiora &
Ghilotti, Inc., do not meet State of California Title 24 Handicap
Access codes required by the City; and
WHEREAS, the cost of the restroom building has increased
from $62,000 to approximately $76,000 in order to meet State of
California Title 24 Handicap Access codes; and
WHEREAS, this $14,000 cost increase is prohibitive within
our current grant funding resources; and
WHEREAS, the Pickleweed Child Care facility must have a
bathroom facility for the exclusive use of the Child Care Center
in order to meet State licensing requirements to operate on
September 6, 1988; and
WHEREAS, we have located a portable bathroom trailer avail-
able from Gelco Space at a sale price equivalent to a nine-month
lease; and
WHEREAS, the City can meet the current need with this
facility for the next school year.
NOW, THEREFORE, BE IT RESOLVED that the City Council,
acting in the best interest of the Public Health, Safety and
Welfare, does hereby waive the bid process and authorizes the
purchase of a portable restroom facility for Pickleweed Child
Care.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of
said City on Tuesdav the Sixth day of September
19 88, by the following vote, to wit:
