HomeMy WebLinkAboutCC Resolution 7865 (Scotts Valley)RESOLUTION NO. 7865 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE SIGNING OF AN AGREEMENT FOR THE PURCHASE AND ASSIGNMENT OF FEDERAL AID URBAN (FAU) APPORTIONMENTS FROM THE CITY OF SCOTTS VALLEY, CALIFORNIA THE CITY COUNCIL OF THE CITY OF SAN RAFAEL hereby resolves as follows: THE MAYOR AND THE CITY CLERK are authorized to sign, on behalf of the City of San Rafael, an agreement with the City of Scotts Valley, California, for the purchase and assignment of Federal Aid Urban (FAU) apportionments. A copy of said agreement is attached hereto and incorporated herein by reference. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City held on the 21st day of November, 1988, by the following vote, to wit: AYES: COUNCILMEMBERS: Boro, Breiner, Frugoli, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None JE LEONCIN1, City Clerk AGREEMENT FOR ASSIGNMENT OF FEDERAL AID URBAN (FAU) APPORTIONMENTS This agreement is made and entered into this _21st day of NovembPr , 1988, by and between the City of San Rafael, hereinafter referred to as San Rafael, and the City of Scotts Valley, hereinafter referred to as "City". WITNESSETH: WHEREAS, City wishes to assign $422,000 of its current balance of FAU funds to San Rafael in exchange for eighty-five percent (85%) of that amount in funds that may be used for any transportation related purpose; and WHEREAS, San Rafael wishes to accept said assignment for use on a transportation project which qualifies for FAU funding; and WHEREAS, the FAU funds are discounted to San Rafael because of expenditure restrictions and increased administrative costs associ- ated with using said funds; and WHEREAS, apportioned nonattributable FAU funds may be transferred between local agencies with the approval of the appropriate local officials and, if applicable, the appropriate governing bodies responsible for apportioning the funds within an urbanized area; and WHEREAS, San Rafael and City consider this assignment and exchange as fair and equitable treatment under the FAU program. ICON, THEREFORE, it is mutually agreed as follows: 1. City agrees to transfer $422,000 of its FAU fund balance to San Rafael. 2. San Rafael agrees to transfer $358,700 to City on notification by Caltrans that the $422,000 is available for San Rafael's use; and 3.
