HomeMy WebLinkAboutCC Resolution 7768 (Eastside Arterial)as follows: RESOLUTION NO. 7768 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE COUNTY OF MARIN, CITY SAN RAFAEL, AND THE CITY OF NOVATO CONCERNING A FEASIBILITY STUDY FOR MCINNIS DRIVE (EASTSIDE ARTERIAL) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES The MAYOR and the CITY CLERK are authorized to execute, on behalf of the the City of San Rafael, an agreement with the County of Marin and the City of Novato for a feasibility study of McInnis Drive, a copy of which is hereby attached and by this reference made a part hereof. LEONCINI, City Clerk ORIGINAL 7 749; -9- AGREEMENT THIS AGREEMENT, made and entered into this day of , 1988, is between the COUNTY OF MARIN, referred to herein as Marin, and the City of Novato, referred to herein as Novato and the City of San Rafael, referred to herein as San Rafael. Recitals 1. Marin, Novato and San Rafael pursuant to Streets and Highway Code Section 941 and 1805 are authorized to design, construct and maintain public streets, roads, and highways needed for public convenience. 2. Marin, Novato, and San Rdfael are participating in the 101 Corridor Study which describes the need for additional north south capacity in the transportation system. One of the most critical areas is between Puerto Suello Hill and Rowland Blvd. Interchange. The study also identifies McInnis Drive as a significant improvement which can provide local circulation in this, area without forcing additional traffic onto Hwy. 101. 3. Marin and San Rafael have policy commitments to McInnis Drive in the Northgate Activity Center Plan and Novato desires to establish an alignment for McInnis Drive in the processing of the Hamilton Master Field Plan and for Bel Marin Keyes and the Novato Redevelopment Project Area #1. It Is Mutually Agreed As Follows: 1. Purpose The parties hereto intend to develop an alignment study of the Eastside Arterial. The Alignment Study is to define: -the purpose of the proposed road, traffic engineering criteria for the road, conceptual engineering, alignment alternatives, environmental effects of each alignment and appropriate mitigation measures, necessary general plan revisions, the costs of each alternative and funding opportunities. 2. Funding The costs of the proposed alignment study, and related coordination between the Marin, San Rafael, and Novato will be shared on the basis of 33 1/3% to the County, 33 1/3% -to San Rafael and 33 1/3% to Novato. Neither the Marin, Sari Rafael nor the Novato share shall exceed the net sums of $25,000 without amendment of this agreement by the Board of Supervisors, San Rafael City Council, and Novato City Council. Any party may undertake other studies not a part hereof at its own expense. Each agency's funds will be placed in a special account of the County Road fund at the start of the project. After all bills are paid, 33 1/3% of all remaining funds will be returned to each agency. 3. Administration The Public Works Directors and Planning Directors from Marin and San Rafael, and the City Engineer and Community Development Director from Novato or their appointees shall be the project management committee for the study. Their responsibilities will include setting the detailed scope of work, selecting a consultant and recommending the consultant to their respective Board/Council for approval, approving progress payments and recommending a final alignment/alternatives to their respective Board/Council. All decisions by the project management committee shall be made by unanimous vote. This committee shall also have two nonvoting advisory members who are engineers for properties along the right-of-way and one nonvoting advisory member who is an environmental interest group representative. 4. Process After the requested funds from each agency have been deposited in a special County account. The management oversight committee shall select and hire a person or consultant to provide extra hire staffing needed to coordinate with each jurisdiction and the consultant and provide minutes of the meetings. The management oversight committee will then review and approve a Request for Proposals for the design and environmental work. Upon receipt of the proposals the management oversight committee shall meet to select a consultant for recommendation to the Marin Board of Supervisors, San Rafael Council and Novato Council. After approval of the consultant by Marin, San Rafael -1- 5. 6. and Novato; Marin will enter into a contract with the consultant to perform the approved scope of work. The consultants work shall be periodically reviewed by the project management committee to insure that the work is proceeding as desired and to authorize payments. Implementation At the conclusion of the study Marin, Novato and San Rafael shall consider the study in public meetings and determine whether or not to enter into an agreement to endorse specific design criteria, specific alignment points at common boundaries, and a specific alignment for the entire length of road. Liability Neither San Rafael, Novato nor any officer, agent or employee thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by Marin under or in connection with any work, authority or jurisdiction delegated to Marin under this agreement. It is also understood and agreed that pursuant to Government Code 895.4, Marin shall fully indemnify and hold San Rafael and Novato harmless from any liability imposed for injury (as defined by Government Code 810.8) occurring by reason of anything done or omitted to be done by Marin under or in connection with any work, authority orjurisdiction delegated to Marin under this agreement. Neither Marin, nor any officer or employee thereof, is responsible for any damage or liability occurring by reason of anything done or omitted to be done by San Rafael or Novato under or in connection with any work, authority or jurisdiction not delegated to Marin under this agreement. It is also understood and agreed that, pursuant to Government Code 895.4, San Rafael or Novato shall fully indemnify and hold Marin harmless from any liability imposed for injury (as defined by Government Code 810.8) occurring by reason of anything done or omitted to be done by San Rafael or Novato under or in connection with any work, authority or jurisdiction not delegated to Marin under this agreement. 7. Modification This agreement may be determined and provisions contained herein may be altered, changed, or amended by mutual consent of the parties hereto IN WITNESS WHEREOF, the parties hereto have caused their duly -authorized representatives to execute the within agreement the day and year first above written. COUNTY OF MARIN Clerk CITY OF NOVATO Clerk CITY OF SAN RAFAEL Clerk AB:nn-A14-5 July 6, 1988 July 7, 1988 RE: REQUEST FOR PROPOSAL FOR PRELIMINARY DESIGN AND ENVIRONMENTAL ASSESSMENT OF MC INNIS DRIVE ALIGNMENT STUDY The County of Marin is inviting environmental, and engineering firms to submit a proposal for feasibility studies of a proposed Eastside Roadway extending from Civic Center Drive in San Rafael to the Rowland Blvd/Hwy 101 Interchange in Novato (see attached map). The feasibility studies are to address preliminary engineering characteristics and assess initial environmental effects of possible alignments. The proposed roadway has been identified as a needed roadway in the 101 Corridor Study. Marin and San Rafael have general plan policy commitments to the Eastside Roadway. Novato is considering amending their General Plan to incorporate an eastside roadway. The currently submitted Hamilton Plans include provisions for an eastside roadway. The purpose of this roadway is to provide an alternate access to developments on fie cast side of"Hwy 101. The proposed 'study is to be funded equally by Marin, Novato, and San Rafael. A joint Agency Project Management Committee with each jurisdictions' two (2) representatives, two (2) local private engineers and an environmental representative will review the work. Scope of Mork The Eastside Roadway is expected to be a limited access two lane roadway in a 100 foot right-of-way which could run from Civic Center Drive in San Rafael to the Rowland Blvd/Highway 101 interchange in Novato. The purpose of tfiis study will be to analyze existing 101 Corridor study, Novato/Caltrans Project Study Report, San Rafael General Plan traffic data to establish the specific traffic needs for the roadway, examine alternate alignments for each section of the roadway, describe major environmental effects of the alignments, provide cost estimates and describe funding systems for the road. More specifically the study will need to address the following: Geometry 1. Review existing data (see page 5) to identify projected traffic volumes and the origin and destination of trips expected to use the Eastside Roadway. No computer modeling of developments trip generation should be required. 2. The desired design/comfortable speed for the roadway shall be 45 MPH 3. Ideittify vertical and horizontal design characteristics that must be met' ,at critical points in the road way and intersection design to provide safe operation for the proposed design speed and roadway purpose. These include vertical and horizontal curvature, intersection spacing and design, and right-of-way requirements. -I - II . Ali anments At least two (2) alternative alignments shall be preliminarily designed and evaluated for each segment of the roadway. Initial recommendations are: 1. Civic Center Drive to Smith Ranch Road a, Along the easterly edge of the NWPRR right-of-way. b. The possibility of a direct connection to the easterly end of the Merrydale overcrossing. 2. Smith Ranch Road or slightly North of Smith Ranch Road to Hamilton. a.. An alignment along the eastern side of the NWPRR right-of-way with at least two intersections and access roads to the west cr-dSsfng' the NWPRR. b. An -alignment crossing to the west side of the NWPRR right-of- way at the southern end of the segment and then crossing back to the east side of the NWPRR right at the northern end of the segment. 3. Hamilton a. An alignment along the western edge of Hangar Row. b. An alignment which diagonals from the NWPRR right-of-way at the southern edge of Hamilton to the northern end of Hangar Row. 4. Bel Marin Keys to Highway 37 a. An alignment from Hamilton to the Hviy 101/Hwy 37 interchange b. An alignment from Hamilton north to Highway 37, approximately one mile east of the Hwy 101/Hwy 37 interchange. 5. North of Highway 37 a. An alignment from the vicinity of the Hwy 101/Hwy 37 interchange to the Rowland Blvd interchange. III Nrthwestersn..Pacific Railroad Right -of -Way Through the 101 Corridor Study the transportation agencies along the 101 !Corridor'from San Francisco to Healdsberg are considering the devoliopment of the NWPRR right-of-way as a major transit corridor. A decision on the specific use of the NWPRR right-of-way is not expected until Fall or Winter 1988/1989. Options currently being considered are a light rail system and a 2 lane reversible high occupancy vehicle route. The potential for grade crossings and/or need fo,r grate separated crossings should be described and evaluated for typ4cal roadway or major access roadway crossings. -2- IV. Environmental and Engineerinq Consideration The consultant will be responsible for the preparation of an environmental assessment describing the anticipated significant environmental effects of the alternate alignments, scope of needed mitigation, and critical engineering features that will affect the selection of a preferred alignment. This analysis is expected to be based on existing data or extrapolations of that data to identify a preferred alignment. At some future time a detailed environmental document is expected to be prepared for construction of the roadway. The issues to be in the environmental assessment include: 1. Wetlands and habitat impacts. The salt marsh harvest mouse has been trapped on the South fork of the Las Gallinas Creek. The salt marsh harvest mouse and clapper rail have been sighted on Novato Creek. The wetland and habitat impacts of an eastside road are a significant issue some Owners of potentially affected properties have been asked to proceed with Army Corps of Engineers jurisdiction determinations to adequately assess wetland impacts. Army Corps of Engineers jurisdictional determination have been made on the Civic Center North, Marin Ranch Airport, Hamilton and Bel Marin Keyes properties. Design should minimize wetlands impacts. Identification of impacted wetlands and an assessment of required mitigation will be needed. No trapping is expected to be required for the initial assessment. 2. Growth inducing effects and access to adjoining properties referenced to existing plans and approvals. 3. Flood control. 4. Noise effects on adjoining development. S. Air Quality including effects on potentially adjacent schools and hospitals should be estimated based on traffic volumes. No detailed air quality modeling should be required. 6. Consistency with existing and proposed public agency plans. Areas which may be subject to State Lands claims should be identified. State lands determinations have been made on Bel Marin Keyes and Hanna. 7. Archaeological effects including potential impacts on the cemetery at the northern end of the St. Vincent property and native American sites identified on Hamilton. Identification of potential impact should be based on records research. - 3 - V. Costs B. Public Facilities including potential impacts on sanitary sewer service spray discharge areas and anticipated discharge areas in Las Gallinas and Novato. The potential impacts on the Honor Farm and Honor Farm expansions should be evaluated. 9. Soils including calculations of quantities of fill required for the alternates. The design should provide acceptable street elevations, after 50 -year settlement. The consultant will be responsible for selecting an appropriate traffic index based on anticipated volume. Settlement projectons should be based on typical conditions and local data for similar areas. No borings should be required 10, Traffic including the alternates need and ability to provide access to adjoining lands. The consultant will be responsible for projecting preliminary costs for right-of-way acquisition, road construction and relocation costs, and magnitude of anticipated mitigation costs. YI. Funding The consultant shall also be responsible for identifying funding sources and the level of funding that they could be expected to provide. Sources should include development funding (including possible assessment districts), Federal Aid, and Sales Tax funding. Available Information The following information is available or will be completed in the near future and can be utilized by the consultant. 1. Hahn Shopping Center EIR. 2. Bel Marin Keys Second Access Study. A Habitat Evaluation Projection is underway. 3. Caltrans Project Study Report Hwy 101/Hwy 37 Miller Creek Rd. to Rowland Blvd. 4. Hamiltgn-Master Plan, Draft EIR on prior plan and comments, Novato-Engineerin Study for McInnis Drive Alignment through Hamilton (the Consultant can request the City of Novato to include specific data within the scope of their engineering study. S. San Rafael General Plan and technical supporting traffic and environmental data. 6. 101 Corridor Study volumes for the McInnis Drive. - 4 - 7. Salem Rice Division of Mines and Geology Soils Stability Maps. 8. North Marin Water District 1" = 100' Topographic Mapping. 9. Marin County Topographic Mapping of McInnis Park area. 10. Individual private property topo of Civic Center North, Marin Ranch Airport, St. Vincents, Hamilton, Bel Marin Keyes, Hahn. Work Products I. Report (65 copies) consisting of preliminary plans at a scale of approximately 1" = 500', and typical cross sections of the alignments , a description of the significant environmental effects of each alignment and scope of required mitigation, project costs and funding options. II. Supplementary Information - three (3) copies only of: 1. Technical traffic data as reconciled for this report from the available data and an explanation of the steps taken to reconcile the data. 2. Preliminary plans at a scale of 1" = 100' cross sections in sufficient detail to show relationships to existing ground improvements and buildings as used as a basis for calculating costs. , 3. Calculation sheets. 4. Referenced design standards. 5. List all agencies contacted and all agency approvals needed to build the project. Presentation and Meetings The consultant will be responsible for: 1. Periodic progress reports to a joint Cities/County Project Management Committee. 2. Contacting owners of affected properties, affected public service agencies and regulatory agencies. 3. Providing presentations to the Marin Board of Supervisors, San Rafael and Novato City Councils and their respective Planning Commissions. - 5 - Proposal Proposals shall include at a minimum the following information: 1. A time schedule for the complete scope of work. 2. The estimated fee and time frame for each component identified in the requested scope of work. 3. A description of the consultants approach to problem areas in each segment of the roadway. These include: a. Creek crossings. b. Wetland Crossings. c. NWPRR Crossings. d. Potential differential settlement. e. Impact to adjoining properties. 4. The names and qualifications of the project manager and other personnel to be engaged in the study. 5. A sample project of similar scope complexity and design prepared by your firm. Consultants wishing to be considered for this work are invited to submit six (6) copies of their proposals and support information on or before A joint Cities and County Project Management committee will review the proposals and invite the top three (3) consultants to an oral interview. The interviews will be approximately 45 minutes long in which time your team will be able to make a presentation and respond to questions from the selection committee.
