RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT
ON THE DRAFT SAN RAFAEL GENERAL PLAN 2000 (THE PROJECT)
WHEREAS, the San Rafael Planning Department has prepared a draft
General Plan pursuant to Planning Commission and City Council direction; and,
WHEREAS, pursuant to the California Environmental Quality Act and City of
San Rafael Environmental Assessment Procedures, it was determined that the draft
General Plan may have a significant adverse impact on the environment and that an
Environmental Impact Report should be prepared; and
WHEREAS, a Notice of Preparation of an EIR, dated March 21, 1986 was
circulated to the State Clearinghouse, Responsible Agencies and Trustee Agencies;
and,
WHEREAS, the San Rafael Planning Department staff completed a Draft
Environmental Impact Report on the Draft General Plan on November 12, 1986; and,
WHEREAS, the Notice of Completion for the Draft Environmental Impact
Report was logged at the State Clearinghouse and the Draft Environmental Impact
Report was circulated for a duly -noticed 45 -day public review period which began
November 14, 1986 and which closed on December 29, 1986; and,
WHEREAS, comments on the Draft Environmental Impact Report were
requested from Responsible Agencies, Trustee Agencies, other state, federal and local
agencies, as well as persons, groups and agencies on the General Plan mailing list,
and others; and,
WHEREAS, the Planning Department prepared Responses to Written
Comments on the Draft Environmental Impact Report (dated July 7, 1987) and an
Addendum to the Draft Environmental Impact Report (dated July 7, 1987) based on
said written comments received by the Planning Department; and,
WHEREAS, the San Rafael Planning Commission held a duly -noticed public
hearing on the Draft Environmental Impact Report and Addendum on August 10, 1987
to accept public testimony and the Planning Department staff provided responses to all
written comments and verbal comments from the public hearing and produced a
document entitled Comments/Responses from the August 10, 1987 Public Hearing on
the Draft General Plan EIR (dated September 9, 1987); and
WHEREAS, responses to all comments were presented to the Planning
Commission on September 14, 1987 and the San Rafael Planning Commission
directed that the Planning Department staff prepare a revised Draft Environmental

Impact Report incorporating analysis of Planning Commission recommended changes
to the Draft San Rafael General Plan 2000 and, thereafter, cause said revised Draft EIR
to be re -circulated for the period required by law and forwarded to the City Council for
its review and consideration for certification; and
WHEREAS, the Planning Department prepared a Revised Draft
Environmental Impact Report in January, 1988; and,
WHEREAS, the Notice of Completion for the Revised Draft Environmental
Impact Report was logged at the State Clearinghouse and the Revised Draft
Environmental Impact Report was circulated for a duly -noticed 45 -day public review
period which began February 5, 1988 and which closed on March 21, 1988; and,
WHEREAS, comments on the Revised Draft Environmental Impact Report
were requested from Responsible Agencies, Trustee Agencies, other state, federal and
local agencies, as well as persons, groups and agencies on the General Plan mailing
list, and others; and,
WHEREAS, the San Rafael City Council held a duly -noticed public hearing
on the Revised Draft Environmental Impact Report on March 17, 1988 to accept public
testimony; and
WHEREAS, the Planning Department prepared Responses to Written
Comments on the Revised Draft EIR on the San Rafael General Plan 2000 (dated May
20, 1988) which included responses to all written and public hearing comments; and,
WHEREAS, the City Council held a public meeting on June 6, 1988 to review
the adequacy of the responses to comments.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Rafael finds that for purposes of certification, the Final EIR for the San Rafael General
Plan 2000 consists of the Revised Draft EIR (dated January, 1988), the Responses to
Written Comments document (dated May 20, 1988), annotated EIR modifications as a
result of MAy, 1988 Responses to Written Comments document, EIR Addendum as a
Result of City Council Expressed Conceptual Agreement on the San Rafael General
Plan 2000 (dated July 14, 1988), Summary of EIR Modifications contained in the May,
1988 Responses to Written Comments document, and this Resolution No. 77'70•
BE IT FURTHER RESOLVED that the City Council of the City of San Rafael
finds and certifies that:
1. The Final EIR has been completed in compliance with the content and
process requirements for EIR's included in CEQA; and
2. The Final EIR was presented to the San Rafael City Council and the
decision making body reviewed and considered the information
contained in the Final EIR prior to approving the project.
