HomeMy WebLinkAboutCC Resolution 7773 (General Plan 2000)RESOLUTION NO. 7773 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DETERMINING THAT THE PRIORITY PROJECT DESIGNATION FOR CREST MARIN II IS A PRIORITY PROJECT CONSISTENT WITH THE SAN RAFAEL GENERAL PLAN 2000 WHEREAS, applications have been submitted to rezone the subject property and to secure use and environmental and design review permits for construction of a 220 unit apartment complex known as Crest Marin II; and WHEREAS, a Focused EIR was prepared assessing potential significant cumulative traffic impacts associated with the project which was presented to the Planning Commission on June 9, 1988, and duly reviewed and considered by the Planning Commission on June 9 and June 28, 1988; and presented to the City Council on July 18, 1988, and duly reviewed and considered by the City Council on July 18, 1988; and WHEREAS, the applicant made numerous modifications to the project during the course of staff and Commission review of the applications in response to staff, Design Review Board and Planning Commission recommendations and City Council modifications to the San Rafael General Plan 2000; and WHEREAS, the Planning Commission and City Council have duly considered all information concerning this project presented by the applicant, the public and the staff and consultants. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby determines that Crest Marin II (as approved by Z85-16, UP85-122 and ED85-109) is a Priority Project consistent with San Rafael General Plan 2000 Policy C-7 with findings as follows: (1) The proposed project is consistent with the Northgate Activity Center Plan and the San Rafael General Plan 2000 in that the project complies with the High Density Residential designation for the property, will not exceed the mid -point Level of Service D p.m. peak hour standard for critical intersections in the San Rafael General Plan 2000, exceeds the mandatory 10% low and/or moderate income housing requirement of Policy H-19 of the San Rafael General Plan 2000 thereby qualifying for density bonus consideration; provides on-site recreational facilities and amenities; poses no hazards regarding health or safety as verified in the Environmental Initial Study; and would result in no other significant environmental effects on the already graded and disturbed site. (2) Crest Marin II is a Priority Project consistent with Policy C-7 of the San Rafael General Plan 2000 in that, unlike any other projects currently proposed, it is a large (220 units), rental, non -age restricted housing project with 7% of the units affordable to moderate income households and 8% of the units affordable to low income households which would meet demonstrated housing needs in the City of San Rafael as documented by the housing portion of the San Rafael General Plan 2000 and the 1985 San Rafael Housing Element; that approval of the project will result in there being remaining p.m. peak hour capacity at the critical intersections at the Lucas Valley Road/Smith Ranch Road/Highway 101 interchange at a time when no 0€ii�d�dAl j�3 other candidate Priority Projects have been identified in the tributary area which would generate p.m. peak hour trips to the critical intersections at the Lucas Valley Road/Smith Ranch Road/101 Interchange; and that if the project is not approved for construction in the near future the current applicants may not be able to proceed with the project, thereby possibly resulting in a loss of this timely opportunity to secure 33 low and moderate income affordable, non -age restricted rental housing units in the City of San Rafael. BE IT FURTHER RESOLVED that the City Council does hereby establish this Priority Project determination for a period of one year or until July 18, 1989. Failure to secure building permits within that time frame unless a time extension(s) is granted by the City Council will render the Priority Project determination null and void. I, JEANNE M.
