RESOLUTION NO. 7685
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL, SITTING AS THE BOARD OF APPEALS,
PURSUANT TO THE PROVISIONS OF THE UNIFORM CODE
FOR ABATEMENT OF DANGEROUS BUILDINGS, DECLARING
THE REAL PROPERTY LOCATED AT 1301-1311 FOURTH
STREET, AP 11-253-10, A DANGEROUS BUILDING AND
ORDERING ITS IMMEDIATE REPAIR OR DEMOLITION
WHEREAS, a fire occurred on July 1, 1987, badly damaging
the real property located at 1301-1311 Fourth Street, AP 11-253-10;
and
WHEREAS, thereafter the City of San Rafael did, on July 2,
1987, post the premises as unsafe; inspect, determine and notify the
owner of said property that the premises were uninhabitable, unsafe
and dangerous, on July 7, 1987; and cause to be issued to the owners
of said premises a NOTICE AND ORDER pursuant to the Uniform Code for
Abatement of Dangerous Buildings, requiring said premises to be
demolished within sixty (60) days; and
WHEREAS, the owners of said premises did fail to appeal
from said NOTICE AND ORDER as permitted under Section 401 of said
Uniform Code for Abatement of Dangerous Buildings within the time
limits set forth therein; and
WHEREAS, the date set by the City for repair or demolition
of the subject structure was extended an additional sixty (60) days
to and including November 7, 1987, at the request of owners; and
WHEREAS, the owners of said premises have failed to submit
appropriate and adequate plans for repair of the fire damaged
building, despite City's repeated request for same; and
WHEREAS, the City Council did conduct a public hearing,
sitting as the Board of Appeals, on February 1, 1988, for the
purpose of determining whether to confirm Staff's recommendation
that the subject premises be demolished or repaired; and

WHEREAS, at said public hearing the owners of the subject
property were personally present and represented by counsel; staff
presented oral and documentary evidence under oath concerning the
condition of the subject premises, and the owners presented
testimony on their behalf.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL, sitting as the Board of Appeals pursuant to the
provisions of the Uniform Code for Abatement of Dangerous Buildings,
on the basis of the evidence presented at the hearing conducted on
February 1, 1988, as follows:
1. The real property located at 1301-1311 Fourth Street,
AP 11-253-10, is a dangerous building within the
meaning of Section 302 of the Uniform Code for
Abatement of Dangerous Buildings;
2. On or before the expiration of three (3) days from
February 1, 1988, the owners of the subject property
shall apply for and obtain all necessary permits and
shall construct temporary improvements to assure, to
the satisfaction of Structural Engineer Robert W.
Copple, that the premises are safe and no longer
present a hazard to the public; the owners shall
include in any such temporary work on the premises
bracing of all upper floor walls and installation of a
new temporary roof structure;
3. On or before the expiration of thirty (30) days from
February 1, 1988, the owners of the subject premises
shall submit a complete application to the Planning
Department for the remodeling of said premises.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on the 16th day of February 1988, by the following vote,
to wit:
