HomeMy WebLinkAboutCC Resolution 7584 (Meyer Rd Subdivision)RESOLUTION NO. 7584 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DENYING AN APPEAL AND UPHOLDING THE PLANNING COMMISSION'S DECISION TO REQUIRE A FOCUSED ENVIRONMENTAL IMPACT REPORT FOR THE PROPOSED MEYER ROAD SEVEN LOT SUBDIVISION MEYER ROAD AND THE END OF "C" STREET (AP 12-291-16 & 17) WHEREAS, in December 1986, the applicants filed a tentative map application for a seven lot single family residential subdivision on an 8.5 acre parcel fronting Meyer Road and the end of "C" Street; and WHEREAS, staff completed an initial environmental study concluding that the project may result in adverse environmental impacts, recommending that a focused environmental impact report be prepared; and WHEREAS, on June 9, 1987, the Planning Commission reviewed the initial study and recommended on a 7-0 vote to require preparation of a focused EIR, with additional issues being added per their discussion; and WHEREAS, on June 16, 1987, the applicants appealed the Planning Commission's decision to the City Council asserting that the requirement to prepare a focused EIR was discriminatory, without reasonable basis and lacked legal authority; and WHEREAS, on July 20, 1987, the City Council held a public hearing on the appeal. After public testimony and lengthy discussion, the City Council denied the appeal and upheld the Planning Commission's decision to prepare an EIR focusing on the following issues: (1) Earth-Soils/Geology (2) Hydrology/Drainage (3) Plant/Animal Life (4) Land Use (5) Transportation/Circulation (6) Fire Safety (7) Archeology (8) An assessment of alternatives to include: (a) Open Space (+ no project alternative) (b) Lower density project (compatible with the draft Hillside Resource land use designation) (c) Redesign of the project at the same density (d) A higher density project (compatible with the draft low density residential land use designation) NOW, THEREFORE, BE IT RESOLVED that the City Council denies the appeal and upholds the Planning Commission decision RESOLUTION NO. 7584 to prepare an EIR for the proposed project focusing on the above listed issues and based on the following findings: A requirement to prepare an focused EIR in this case is necessary to address potential environmental impacts associated with the proposed seven lot subdivision. Preparation of an EIR focusing on the above issues would be consistent with Section 15064 of the California Environmental Quality Act which pertains to determining significant environmental effects and judgment of public controversy. Based upon the record, neighborhood controvery does exist and experts' opinions have been questioned. Preparation of a focused EIR would provide a third party analysis of the conclusions of the various reports contained in the initial study document. I, JEANNE M.
