RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
UPHOLDING AN APPEAL AND DENYING THE PLANNING COMMISSION'S
DECISION TO REQUIRE NATURAL CEDAR SIDING
FOR THE EXTERIOR BUILDING MATERIALS
AT SUMMERHILL TOWNHOUSE/PATIO HOME DEVELOPMENT

WHEREAS, on June 24, 1986, the Planning Commission
conditionally approved an environmental and design review permit
for the Summerhill townhouse and patio home development. The
permit was approved with a condition requiring that either
natural cedar or redwood exterior siding be installed for all
units; and
WHEREAS, on June 10, 1987, the Zoning Administrator
reviewed a design review amendment request to change the approved
siding material from natural cedar to manufactured masonite;
and
WHEREAS, the Zoning Administrator referred the matter
to the Planning Commission given the neighborhood opposition
to the proposed masonite material and the Planning Commission's
previous approval of natural siding based upon compatibility
of materials with the surrounding neighborhood; and
WHEREAS, on June 23, 1987, the Planning Commission
reviewed the proposed design review permit amendment. After
receiving public testimony and listening to an extensive presentation
by the masonite manufacturers, a Planning Commission motion
to approve the change in siding material failed on a 3-4 vote;
and
WHEREAS, on June 24, 1987, the applicants appealed
the Planning Commission decision to the City Council; and
WHEREAS, on July 6, 1987, the City Council held a
public hearing on the appeal. The City Council received a
similar presentation by the masonite manufacturers and received
public testimony from applicant and representatives in the
neighborhood. A motion to approve the appeal was successful
and was granted.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council upholds the appeal and permits use of manufactured

masonite siding based upon the following findings and amended
condition (o) in Exhibit "A":
The design review amendment to permit manufactured
masonite siding is consistent with the criteria established
for approving such permits provided that the material
is installed per the manufacturer's specifications
as required by conditions of approval. Furthermore,
it is determined that the masonite siding is a material
compatible with exterior building materials found
in the surrounding neighborhood.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on MONDAY , the THIRD day of AUGUST
1987, by the following vote, to wit:

Revised condition of approval for ED85-105(b)
(o) Manufactured masonite siding shall be considered an acceptable exterior
building material provided that it is installed according to the
manufacturers specifications and is of the highest quality material
available. Specifications for installation shall be approved by the
Planning Department prior to installation. Furthermore, the material
specifications shall be attached to the building drawings and main-
tained on the job site at all times during construction.
