RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AUTHORIZING A PARTIAL REFUND GAF EAST
SAN RAFAEL TRAFFIC MITIGATION FEES FOR THE MARIN
HOME IMPROVEMENT CENTER, LOCATED AT
530 FRANCISCO BOULEVARD WEST.
WHEREAS, on July 16, 1984, the Council established an East San Rafael
traffic mitigation fee for the Home Improvement Center, located at 530 Francisco
Boulevard West, based upon a mix of bulk and small item retail home improvement
uses. Based on the proposed uses, the fee was paid at an amount of $154,886.00;
and
WHEREAS, the home improvement center has been built and occupied by all
large and bulk retail home improvement uses; and the property owner requested a
zone change and use permit amendment limiting uses as such in order to receive a
refund on a portion of traffic mitigation fees; and
WHEREAS, the Planning Commission on July 28, 1987, recommended adoption
of the zone change with conditions/development standards limiting the uses and a
partial refund of the traffic mitigation fees in the amount of $91,560.00. This
refund is reasonable based on a finding that the zoning and use permit amendment
would establish control of all uses to insure monitoring of traffic generated by
the Center, and to ensure the adequacy of parking.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council concurs
with the Planning Commissions recommendation and authorizes the partial refund of
East San Rafael traffic mitigation fees for the Home Improvement Center in the
amount of $91,560.00.
