RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL AUTHORIZING THE SIGNING
OF GRANT DEED OF EASEMENT FOR PUBLIC UTILITY
PURPOSES - WINDWARD WAY SUBDIVISION TO PG&E
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as
The Mayor and City Clerk are authorized to execute, on behalf
of the City of San Rafael, a grant deed of easement for public utility
purposes to Pacific Gas and Electric Co. in the Windward Way
Subdivision, a copy of which is attached hereto, and incorporated
herein by this reference.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council
of said City held on the 5th day of January, 1987, by the following
vote, to wit:

THE CITY OF SAN RAFAEL, a public body of the State of California,
EASEMENT
first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a California corporation,
second party, the right from time to time to construct, reconstruct, install, inspect, maintain, replace,
remove, and use facilities of the type hereinafter specified, together with a right of way therefor,
within a strip or parcel of land or along a route as hereinafter set forth, and also ingress thereto and
egress therefrom, over and across the lands situate in the City of San Rafael
County of Marin , State of California, described as follows:

A strip of land of the uniform width of 5 feet lying contiguous to and
westerly and southwesterly of a line which begins at the intersection of
the northerly boundary line of Lot 8 with the westerly boundary line of
Windward Way as shown upon the flap of Windward Way filed for record in
Book 19 of Maps at page 60, Marin County Records, and runs thence
N20000'00"E 100.74 feet; thence on a curve to the left with a radius of
20 feet through an angle of 90000'00" for a distance of 31.42 feet, more
or less, to a point in the southwesterly boundary line of Bellam
Boulevard, as shown upon said map.
Said facilities shall consist of:
One or more underground pipes vith suitable service pipes and connections for
the conveyance of gay by Pacific Gas and Electric Company; and such .
underground conduits, pipes, manholes, service boxes, wires, cables and
electrical conductors; aboveground marker posts, risers, and service
pedestals; underground and aboveground switches, fuses, terminals, and
transformers with associated concrete pads; and fixtures and appurtenances
necessary to any and all thereof, as second party deems necessary located
within the strip of land hereinbefore described.

First party further grants -to second party the right to assign to another
public utility as defined in Section 216 of the California Public Utilities
Code the right 'to install, inspect, maintain, replace, remove and use
communication facilities within said strip of land hereinbefore described
(including ingress thereto and egress therefrom).

First party shall not erect or construct any bu'Iding or other structure or drill or operate any well
within said strip of land hereinbefore described.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the
respective parties hereto.
