RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT FOR ASSISTANT CIVIL ENGINEER (LAND
DEVELOPMENT) WITH JAMES L. HALLBERG
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY
RESOLVES as follows:
The City Manager is authorized to execute, on behalf of
the City of San Rafael, an agreement with James L. Hallberg for
engineering services as an Assistant Civil Engineer in the Land
Development Division of the Department of Public Works, a copy of
which is attached hereto and incorporated herein by this reference.
I, JEANNE M. LEONCINI, City Clerk of the City of San
Rafael, California, hereby certify that the foregoing resolution was
duly and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 19th day of January, 1987, by the
following vote, to wit:

AGREEMENT
This Agreement made and entered into this 30th day of March,
1987, by and between. the CITY OF SAN RAFAEL, hereinafter referred to as
"City" and Jay L. Hallberg, hereinafter referred to as "Assistant Civil
Engineer";
WITNESSETH:
WHEREAS, the City has received fees to provide for the check-
ing of plans and inspection of construction for various subdivisions
and other land development projects; and has funding available to
perform similar duties for various Redevelopment projects;; and
WHEREAS, the City has determined that it is in the public
interest to insure the above mentioned projects are constructed in a
timely and professional manner;
NOW, THEREFORE, in consideration of the mutual covenants and
agreements contained herein, the parties hereby agree as follows:
1. The City hereby employs Assistant Civil Engineer to serve
as a contract employee for a period of one year from the date hereof.
2. Contract period shall begin April 15, 1987 and shall run
no longer than April 15, 1988 unless extended by mutual consent.
3. Assistant Civil Engineer will work regular City Hall hours
(37-1/2 hours) 8:30 a.m. to 5:00 p.m., five days a week. Flex time
will be subject to the Director of Public Works' approval. Overtime
will be only with prior authorization by the Director of Public Works,
and paid at the rate of time and one-half pay in accordance with
adopted City policy. Any time worked in excess of a 37 1/2 - hour work
week will be returned that same week, or the employee will be compen-
sated at the rate of time and one-half pay.
4. Assistant Civil Engineer agrees to provide professional
engineering services necessary to review and check plans and maps
submitted for approval by the City. Examples of duties assigned to
this position are as follows: Under general direction, the Assistant

Civil Engineer reviews and approves maps and construction plans for
compliance with various codes, ordinances and conditions of approval;
coordinates the review and inspection of construction with various
employees in the Public Works Department, City departments and other
governmental agencies.
5. Salary shall be set at Range 39, Step D, and shall be paid
twice each month on the business day falling on or nearest the fif-
teenth and the final day of the month in the same manner as full-time,
permanent employees of the City of qan Rafael.
6. Assistant Civil Engineer will be entitled to all insurance
fringe benefits of regular full time employees (Health, Dental, Life,
and Long Term Disability). Retirement benefits will not be included.
7. Assistant Civil Engineer will be given a credit for 10
days vacation for recent past service; and in recognition of a total
of over 10 years past service to the City he will accrue vacation, sick
leave, holiday pay and floating holiday pay at the rate prescribed for
employees with a minimum of 10 years of service.
8. Assistant Civil Engineer will be covered by all Worker's
Compensation laws.
9. This Agreement may be terminated for any reason by either
party at any time upon thirty (30) days written notice to all parties
to this Agreement.
