A RESOLUTION AUTHORIZING THE SIGNING OF AN AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The CITY MANAGER and CITY CLERK are authorized to execute,
on behalf of the City of San Rafael, an agreement with NADER
MANSOURIAN, Traffic Technician, a copy of which is hereby attached
and by this reference made a part hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Mondav , the 19th day of January ,
1987, by the following vote, to wit:

AGREEMENT
This Agreement made and entered into this 19th day
of January, 1987, by and between the SAN RAFAEL REDEVELOPMENT
AGENCY/CITY OF SAN RAFAEL, hereinaf-tea referred to as "Agency/
City" and NADER MANSOURIAN, hereinaft:er referred to as "Traffic
Technician";
WITNESSETH:
WHEREAS, the City has determined that the General
Plan needs to be updated; and
WHEREAS, the transportation and circulation element
is an integral part of said General Plan; and
WHEREAS, it is necessary 'to collect traffic data
to provide an accurate base and to develop a model projecting
future traffic conditions for the transportation and circulation
element of the General Plan; and
WHEREAS, it is necessary to employ a traffic technician
for a limited duration to perform such traffic and transportation
studies work.
NOW, THEREFORE, in consideration of the mutual. covenants
and agreements contained herein, the parties hereby agree as
follows:
(1) The Agency/City hereby employs the Traffic Technician
to serve as contract employee from February 3, 1987, to the
end of the 1986/1987 fiscal year, June 30, 1987.
(2) Traffic Technician agrees to work thirty-seven and
one-half (372) hours a week. The hours will be dictated by
morning and afternoon peak traffic conditions. Traffic Technician
agrees to work a flexible schedule in order to measure these
peak conditions. Traffic Technician understands that such
schedule may include one or more ten (10) hour days per week
at the rate of pay set forth in Paragraph (4) hereinbelow.
Overtime hours will be permitted only upon prior authorization
by the Director of Public Works or the Planning Director or
their designated representatives. Overtime shall only be granted
when Traffic Technician has satisfied one of the following
conditions:

(a) The �'raffic Technician has wori.cd more than
ten (10) hours in any calendar day.
(b) The total hours worked in any calendar week
exceed thirty-seven and one-half (372) hours.
Overtime shall be at the rate of time and one-half pay in accordance
with adopted City policy.
(3) Traffic Technician agrees to perform traffic and
transportation studies work for Agency, Public Works and Planning
projects. Examples of duties assigned to this position include
but are not limited to: conduct manual and machine traffic
counts; conduct origin -destination studies; 'conduct speed studies;
inventory traffic control devices; prepare collision diagrams;
microcomputer data entry; speed and delay studies; conduct
noise level readings.
(4) Salary shall be set at $1,846.57 per month and shall
be paid from the first day of employment. Traffic Technician
shall be paid twice each month on the business day falling
on or nearest the fifteenth and the final day of the month
in the same manner as full-time permanent employees at the
City of San Rafael.
(5) Traffic Technician shall be entitled to the following
benefits:
(a) Ten (10) days of vacation per year, or 0.83
days per month for the term of this agreement. Vacation
shall be accumulated from the first day of employment
but may not be used during the first six months. All
vacation earned shall be used during the term of the contract
or lost unless written approval is obtained from the Director
of Public Works,
(b) Compensation for the nine (9) legal holidays
defined in City Council Resolution 5802, if said holidays
fall within the term of employment.
(c) A maximun► contribution of $245.00 per month
toward one of the three City recognized medical health
plans. Said contribution shall be limited to the cost
of the plan selected by the Traffic Technician.
Traffic Technician shall not be be entitled to sick leave,
life insurance, disability insurance, or dental health bene its.
(6) Traffic Technician understands that he will not be
entitled to unemployment compensation at the expiration of
the term of this Agreement and waives the right to raise any
claim against the City in that regard.
(7) This Agreement may be terminated for any reason by
either party at any time upon thirty (30) days written notice
to all parties to this Agreement.

into this Agreement the day and year first above written.
