RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL ORDERING CLOSING, ABANDONING
AND VACATING 10' WIDE SEWER OUTFALL
EASEMENT, MAP OF WINDWARD WAY, SAN RAFAEL,
CALIFORNIA
WHEREAS, the City Council of the City of San Rafael on the
15th day of December, 1986, adopted Resolution No. 7464 entitled,
"RESOLUTION OF INTENTION TO VACATE 10' WIDE SEWER OUTFALL EASEMENT -
MAP OF WINDWARD WAY, SAN RAFAEL, CALIFORNIA"; and
WHEREAS, said Resolution was posted as required by law; and
WHEREAS, the Department of Public Works of the City of San
Rafael, California, conspicuously posted notices of easement vacation
as required by law; and
WHEREAS, a hearing was had this day as required by law and
said Resolution No. 7464, at which hearing the Council of the City of
San Rafael heard evidence offered by persons interested; and
WHEREAS, it appears from all of the evidence that the follow-
ing described sewer outfall easement is unnecessary for present or
prospective public use;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the following described sewer outfall easement is
unnecessary for present or prospective public use;
2. That the following described sewer outfall easement is
hereby ordered closed, abandoned and vacated;
3. That the sewer outfall easement closed, abandoned and
vacated is described on Exhibit "A" which is attached hereto and incor-
porated herein by reference.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council of
said City held on the 19th day of January, 1987, by the following vote,
to wit:

NOES: COUNCILMEMBERS: None

DESCRIPTION OF 10' WIDE SEWER
OUTFALL EASEMENT TO BE VACATED
All that real property situate in the City of San Rafael, County
of Marin, State of California, described as follows:
All that portion of that certain 10' wide Sewer Outfall Easement
as said easement is shown on that certain map entitled "Map of Windward
Way, being a subdivision of Parcel 'A' as shown on 21 P.M. 76",
recorded October 11, 1985 in Volume 19 of Maps at page 60, Marin
County Records, and more fully described on said map as "10' Sewer
Outfall Easement to City of San Rafael (149 O.R. 51)".
