RESOLUTION NO. 7534
RESOLUTION OF INTENTION TO ENTER INTO AN
AGREEMENT WITH THE SAN RAFAEL SANITATION
DISTRICT FOR THE TRANSFER OF THE SANITARY
SEWER GRAVITY COLLECTION SYSTEM
WHEREAS, the City owns, maintains and is otherwise
responsible for the sanitary sewer gravity collection system
within the jurisdictional limits of the District; and,
WHEREAS, the City is desirous of transferring ownership,
maintenance and liability of said system to the District; and,
WHEREAS, the City currently maintains District facili-
ties under an agreement dated November 5, 1969; and,
WHEREAS, the City, once ownership, maintenance and
liability of said system is transferred to the District, would
maintain all District facilities pursuant to said agreement includ-
ing the newly transferred gravity sewer collection system; and,
WHEREAS, the City is desirous of establishing the
basis for said transfer; and
WHEREAS, it is in the best interests of the health,
and safety of the citizens of San Rafael that this transfer take
place; and
WHEREAS, the transfer will correct a current inequity
for those San Rafael property owners north of Puerto Suello Hill;
and
WHEREAS, the transfer will provide more effective
enforcement power for SRSD especially for source control and
facilities access; and
WHEREAS, wastewater operations will be consolidated
in one organization; and
WHEREAS, coordination will be simplified between the
City and District; and
WHEREAS, the potential for jurisdictional disputes
will be eliminated; and
WHEREAS, this transfer will more closely resemble
those areas of responsibility that sanitation districts normally
have.

NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of San Rafael hereby announces its intent to ultimately
enter into an agreement with the San Rafael Sanitation District
for the transfer of the Sanitary Sewer Gravity Collection System.
I, JEANNE J. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of
said City on Monday, the 4th day of May, 1987, by the following
vote, to wit:
