RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ACCEPTING CONVEYANCE OF REAL
PROPERTY LOCATED IN SAN FRANCISCO BAY ADJACENT
TO AND NEAR PELICAN WAY IN SAN RAFAEL. (FROM HORST
& IRENE HANF & WM. H. & ILSE C. POESCHL)
WHEREAS, the public interest, convenience, necessity and
welfare require that the real property hereinafter mentioned be
a6cepted and used for the benefit of the public of the City of San
Rafael, California;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of San Rafael, California, does hereby accept that certain
deed for and on behalf of the City of San Rafael and the real
property described therein, all as more particularly described and
set forth in Exhibit "A" attached hereto and incorporated herein by
reference, and the Clerk of said City is hereby directed to cause
said deed to be duly recorded in the Office of the County Recorder
of the County of Marin, State of California, forthwith upon the
adoption of this resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 5th day of May, 1986, by the fol-
lowing vote, to wit:

as Community Property, as to an undivided 500
interest; WILLIAM H. POESCHL and ILSE C. POESCBL, ,the first part 1eS ,hereby
husband and wife, as Community Property, as to an
undivided 26.5% interest; and WP PARTNERSHIP, a
California Partnership, as to an undivided 23.50
interest.
GRANT to: THE CITY OF SAN RAFAEL , the second party

of Marin , State of California, and bounded and described as follows:
Parcel D as shown upon that certain map described as the "Parcel Map of a Lot Line
Consolidation and Resubdivision of Lands of Hanf. Poeschl & W.P. Partnership",
as recorded December 28, 1984 in Book 22 of Parcel Maps at Page 50 in the City of
San Rafael, County of Marin, State of California.
This particular parcel is subject to the following permenent shoreline condition
as imposed by the San Francisco Bay Conservation and Development Commission Permit
No. M82-79, dated September 22, 1982:
Parcel D shall remain in its present "tidal action" natural state with
the exception that placement of protective works along the shoreline, such
as riprap, may be allowed for provided that such work is authorized by the
San Francisco Bay Conservation and Development Commission.
