A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
DENYING AN APPEAL AND UPHOLDING THE
PLANNING COMMISSION ACTION TO CERTIFY
A NEGATIVE DECLARATION AND CONDITIONALLY APPROVE
PERMITS FOR THE SUMMERHILL RESIDENTIAL PROJECT
PROPOSED FOR 211 LOS RANCHITOS ROAD
WHEREAS, in October 1985 the City of San Rafael received
use permit, design review permit and tentative map applications
for development of a portion of the Hartzell School site with
a 48 unit townhouse and patio home development; and
WHEREAS, the applications were filed as a follow-up
to the City's 1984 adoption of P -D (Planned Development) zoning
and execution of a Memorandum of Understanding for redevelopment
of the Hartzell School site; and
WHEREAS, after a lengthy environmental and design
review process the Planning Commission on June 24, 1986, certified
a Negative Declaration and conditionally approved the requested
applications finding the project consistent with the P -D zoning,
Memorandum of Understanding and overall attractive in design;
and
WHEREAS, on June 30, 1986, representatives from four
surrounding neighborhood associations filed an appeal on the
Planning Commission's decision. The appellants claim that
the project is not acceptable to the community and questioned
the acceptabiity of a number of project features. The appellants
also claimed that there was not enough input from the neighborhood
in the design of the residential project; and
WHEREAS, on July 21, 1986, the City Council held
a hearing on the appeal. After receiving public testimony
and discussing the item, the City Council concluded that the
project is attractively designed and consistent with the P -D
zoning and executed Memorandum of Understanding.
NOW, THEREFORE, BE IT RESOLVED that the City Council
denies the appeal and upholds the Planning Commission decision
to certify a Negative Declaration and conditionally approve
the proposed project based on the findings in the Planning
Commission staff reports dated May 27 and June 24, 1986.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Monday , the 4th day of August
