RESOLUTION ESTABLISHING PROCEDURES FOR
PROCESSING APPLICATIONS DURING
PUBLIC REVIEW AND CONSIDERATION
OF A REVISED GENERAL PLAN FOR THE CITY OF SAN RAFAEL
WHEREAS, pursuant to the provisions of California
Government Code Section 65858, the City Council of the City
of San Rafael adopted Interim Urgency Ordinances No. 1524 and
1529 on January 20, 1986, and March 3, 1986, respectively,
prohibiting any uses that may be in conflict with the revision
of the San Rafael General Plan and any necessary and attendant
Zoning and Subdivision Ordinance amendments required in connection
therewith; and
WHEREAS, those Ordinances were enacted for the preservation
of the public health, safety or welfare because there existed
a then current and immediate threat to the public health, safety
or welfare unless building development within the City of San
Rafael was temporarily restricted during the conduct of studies
and the ongoing revision of the San Rafael General Plan and
any necessary and attendant Zoning and Subdivision Ordinance
amendments required in connection therewith; and
WHEREAS, Interim Urgency Ordinance No. 1529 is in
effect only until September 8, 1986, it is necessary for the
continued preservation of the public health, safety or welfare
and so as to regulate the processing of development applications
in an orderly fashion following expiration of Ordinance No.
1529 to institute special procedures for the processing of
applications during the public review and Planning Commission
and City Council consideration of a draft revised General Plan.
Without adopting such procedures, the number of development
applications which may be submitted could well exceed the capacity
of the Planning Department to process efficiently and effectively
such applications, and without such special procedures applications
would be submitted for projects which may be prejudicial to
the revised General Plan and would have to be acted on prior
to final adoption of said revised General Plan by the San Rafael
City Council; and

WHEREAS, the Council considered information received,
testimony heard and staff presentations at a duly noticed public
hearing on September 2, 1986.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of San Rafael does hereby establish the following
procedures for processing of all applications subject to Planning
Department review:
(a) Effective September 8, 1986, Planning staff shall
continue to receive applications listed in Division
3 of Ordinance 1529.
(b) Effective September 8, 1986, Planning staff shall
reactivate complete applications which are consistent
with the draft revised General Plan to be released
in September 1986.
(c) Effective October 1, 1986, Planning staff shall accept
resubmitted applications which were voluntarily withdrawn
or which were denied without prejudice during the
effectiveness of Ordinances 1524 and 1529 and which
are consistent with the draft revised General Plan
to be released in September 1986.
(d) Effective October 15, 1986, Planning staff shall
accept all other applications which are consistent
with the draft revised General Plan to be released
in September 1986.
(e) Effective September 1986 and until a revised General
Plan is adopted by the City Council, Planning staff
shall accept no more than 50 applications in any
calendar month.
BE IT FURTHER RESOLVED that no development application
shall be approved by the City unless findings shall have first
been made determining that said project is consistent with
the revised General Plan to be adopted, as well as the revised
Zoning and Subdivision Ordinances to be adopted pursuant thereto.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Tuesday , the 2nd day of September ,
1986, by the following vote, to wit:
