RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL WAIVING FORMAL BID PROCESS FOR
DRAINAGE IMPROVEMENTS AT 71 CONVENT COURT
WHEREAS, a headwall and storm drain pipe on City -owned open
space land and within a City easement collects water from said open
space and carries said water through property located at 71 Convent
Court; and
WHEREAS, in January 1982 and again in February 1986 the
inlet at said headwall became plugged and flooded the backyard of the
aforementioned property; and
WHEREAS, the property owner at 71 Convent Court has filed a
claim with the City for damages incurred as a result of said floods;
and
WHEREAS, City's insurance coverage would not apply in this
case because said damage occurred within the City -owned and maintained
easement; and
WHEREAS, corrective work must be done prior to this
winter's rains in order to prevent any further damage from occurring;
and
WHEREAS, if City follows usual public bid procedures, the
required work would not commence until the worst of the rains are
over. Staff is, therefore, requesting the City Council to waive the
formal bid process in this case in the interest of public safety.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael that the public health, safety and welfare neces-
sitate the waiver of the City's Charter provisions for competitive
bidding to affect storm damage repairs at 71 Convent Court and directs
staff to proceed with said work with all possible dispatch.
BE IT FURTHER RESOLVED that said Council hereby authorizes
the use of $10,000 of unallocated reserves to fund said work.
