HomeMy WebLinkAboutCC Resolution 7444 (Senior Citizen Residential Development)RESOLUTION NO. 7444 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL UPHOLDING AN APPEAL OF THE PLANNING COMMISSION'S DENIAL OF DESIGN REVISIONS TO THE CALIFORNIAN (FORMERLY CENTERTOWN) SENIOR CITIZEN RESIDENTIAL DEVELOPMENT LOCATED AT 855 "C" STREET WHEREAS, in 1984 zoning, use permit and design review permit approvals were granted for a 63 unit senior citizen residential condominium development on the subject property; and WHEREAS, in October 1985 the applicant submitted a design review permit amendment requesting a number of design modifications to the project which include changes in the floor plans, private and common deck/patio areas and building elevations; and WHEREAS, the design amendments were reviewed by the Design Review Board. After several modifications to the plans, the Design Review Board recommended that the revisions be denied; and WHEREAS, on July 15, 1986, the design review permit amendment was denied by the Planning Commission on a 6-0 vote; and WHEREAS, the Planning Commission's action was appealed to the City Council. On August 18, 1986, the City Council held a public hearing on the appeal. After receiving public testimony and closing the hearing, the City Council continued the matter for further design revisions; and WHEREAS, on September 15, 1986, further design revisions were presented to the City Council. On a 3-1 vote (Breiner dissenting, Russom absent), the City Council upheld the appeal and approved the design review permit amendment, directing staff to prepare a resolution and permit conditions. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council upholds the appeal and grants conditional approval of design modifications for the Californian (formerly Centertown) with the conditions outlined in attached Exhibit "A" and based upon the following findings: 9RIGINA[ ,¢�z RESOLUTION NO. 7444 "As modified by conditions of approval, the design modifications as presented would be consistent with the criteria established for approving design review applications. Revisions have been made to the building elevations so that they are more reminiscent of the originally approved project design. Furthermore, changes have been made to the floor plans and private outdoor balconies and patios to improve function and usability." I, JEANNE M. LEONCI I, City Clerk EXHIBIT "A" Conditions of Approval ED85-117 * Conditions amended from previous approval FIRE DEPARTMENT (a) The applicant shall provide an approved automatic fire sprinkler system to the satisfaction of the Fire Department. Alarms from the required system shall be transmitted to fire alarm headquarters per City Ordinance 1364. POLICE DEPARTMENT (b) The applicant shall install security gates at entrances to the interior parking lot. (c) A key or card control system shall secure doors into the project from the garage and primary entrances(s). Ground level exterior stairs shall also be secured to the satisfaction of the Police Department. (d) An intercom system shall be installed for the condominium to the satisfaction of the Police Department. (e) All ground level exterior levels shall be lighted to two foot candles minimum maintained six feet from the ground. All ground level exterior lights shall be vandal resistant. All stairwells, roof terraces and balconies shall be equipped with vertical lighting one-half foot candle six feet from the ground. All shall be to the satisfaction of the Police Department. (f) All units shall be plainly numbered to the satisfaction of the Police Department. (g) All roof vents, skylights, light wells and air conditioning ducts shall be grated or constructed of an impact resistant material to prevent entry to the satisfaction of the Police Department. (h) All exterior man doors shall be of solid core construction and equipped with deadbolt locks and 180° viewers. The deadbolts shall extend into the door frame one-fourth inch and be fitted with single cylinder and spinning beveled cylinder guards, one inch or larger throw bolts, bolts with case hardened inserts and reinforced 16 gauge style plates with two and one-half inch screws. All windows shall have secondary locks. All locks shall be to the satisfaction of the Police Department. (i) All ground level windows shall be equipped with security type glazing. PUBLIC WORKS (j) An engineered site plan shall be submitted with the application for building permits. (k) A soils report shall be submitted with the application for building permits. All foundation and earth work shall be done under the direction of the soils engineer, and the final report shall be submitted prior to occupancy. (1) A new sidewalk shall be constructed along the entire frontage. (m) All unused driveway shall be removed, and a new curb and gutter shall be constructed along the entire "C" Street frontage and along the Third Street frontage in areas determined by the City Engineer. -I- (n) The proposed parking lot pavement shall be marked/painted with appropriate directional signs and arrows for ingress and egress. This shall be done to the satisfaction of the Traffic Engineer prior to building permit issuance. Handicapped, compact and visitor parking shall be appropriately marked on the pavement. (o) A minimum of ten percent of all units shall be designed so they can easily be converted to handicapped accessible units. (p) Storm drain drop inlets and lines shall be designed so that no water remains after a rain or from incidental irrigation. PLANNING DEPARTMENT (q) The building techniques, materials, elevations and appearance of this project, as presented for approval dated August 28, 1986, shall be the same as required for the issuance of a building permit. Any future additions, expansions, remodeling, etc., shall be subject to the review and approval of the Planning Department. Approved design details shall include the following: (1) Cedar or redwood single (shakes) are approved for the exterior building material with the wood trim stained in a dark rust color. (2) As specified in the plans, the elevator tower and stairwell projections shall be "capped" with a non -reflective metal seam material in a rust color to match the wood trim. (3) All "angled" features such as the roof of the stairwell projections, elevator tower and side privacy walls proposed on the top floor balconies shall be consistent in design and degree of slope. (4) The roofline of the outermost projecting wall along the Third Street frontage (the plane that is flush with the corner balcony railings) shall be softened by introducing an angle with use of the metal seam roof material mentioned under condition (q)(2). Such a feature would provide a more interesting roofline along this highly visible frontage. (r) Detailed landscaping and irrigation plans shall be submitted to the Planning Department for approval prior to issuance of a building permit. (1) Plans shall include street trees along Third and "C" Streets and landscaping in portions of the public right-of-way along Third Street. (2) The easternmost existing eucalyptus tree along Third Street shall be replaced and the proposed ceanothus at the picnic area shall be modified. (3) The applicant shall submit structural calculations with the building permit demonstrating that central courtyard and roof terrace landscaping can be adequately supported. (s) Details of the proposed pavement materials for walkway areas and fence and wall materials shall be submitted with the building permit plans for review by the Planning Director. Fences along the south and west sides of the structure shall be solid with no cracks for noise reduction. (t) The design of the proposed trash enclosure shall include a trellis or roof structure to screen views from the building. The enclosure design shall be subject to Planning Director approval prior to building permit issuance. 2 (u) The applicant shall submit a plan for landscaping and parking for the building at the corner of Third and "D" Streets prior to buildng permit issuance. The parking lot shall be available for use prior to final occupancy. (v) Prior to building permit issuance, the applicant shall submit a noise analysis prepared by an acoustical engineer which indicates how construction will clearly exceed minimum State exterior to interior and impact sound transmission standards. If construction will minimally meet the noise standards, interior levels shall be monitored and certified by a noise engineer paid for by the applicant prior to occupancy to ensure the standards are met. (w) The proposed bocce ball court shall be eliminated. An open exercise area shall be provided on roof terrace level four or five. Sunny, private seating area(s) shall be provided which are sheltered form the wind. The applicant shall provide tables, chairs and other recreation equipment for the lounge, picnic area and roof terraces as well as standard kitchen appliances for the lounge kitchen. * (x) All previous approvals and conditions for Z82 -18(b) and UP82-91(b) shall remain unchanged. * (y) A revised tentative and final map application shall be filed if the units are sold as condominium(s). The maps shall be changed to reflect amendments in the floor plans, private patio/balcony areas and common areas. * (z) This design review permit requires the installation of one elevator with the dimensions and location as specified in the plans (6'0" deep by 8'0" wide). The elevator shall be located at the initially approved location (near "C" Street frontage). * (aa) This design review permit is approved until January 15, 1987 (same time limits for use permit). If a building permit is not issued by that date, a time extension must be granted. - 3 -
