RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL APPROVING THE 1986-
87 "LATCHKEY" FUNDS CONTRACT WITH THE
STATE DEPARTMENT OF EDUCATION
($48,780)
WHEREAS, the Legislature of the State of
California has enacted the Roberti (SB303) Extended
Day Care Services Bill, which provides funding for Child
Care programs; and
WHEREAS, the State Department of Education has
been delegated the responsibility for the administration of
the program and distribution of program funds; and
WHEREAS, the City of San Rafael Child Care
Program has been awarded a Child Care services contract; and
WHEREAS, the State Department of Education has
adopted a cost of living adjustment;
NOW, THEREFORE, BE IT RESOLVED that the City
Council of the City of San Rafael authorizes the City
Manager to execute local agreement number CD -9277 in the
new amount of $48,780.00 for the purpose of providing child
care and development services in the fiscal year 1986-87
and authorizes the Recreation Director to sign the Attendance
and Fiscal Reports required to be submitted monthly to the
State Department of Education,

3. The contractor has not submitted the required fiscal report on or
before the glue date.
4. Based on fiscal reports submitted to the LAB the contractor may
not earn the full MRA.
Tf any apportionment is to be reduced or cancelled, the LAB shall
provide the contractor prior written notification. When applicable,
such notice shall include information regardinq the contractor's

K. Retained Retirement Contributions
on termination of an employee's employment, any retirement
contributions to which the contractor has access shall be offset
against allowable costs to the extent of the arrount retained, plus any
income attributable to such amounts for the period held, unless used
by the contractor to provide additional hours of enrollment
beyond the mininum specified in the contract at a rate equal to the
contract rate or actual cost, whichever is less.

A. General
All contractors shall follow the accounting procedures specified in
the the most recent edition of the California School Accounting
Manual. Contractors may report expenditures on an accrual basis.
R. Child Development Fund
A Child Development Fund shall be established in accordance with
California Administrative Code, Title 5, Section 17906 (a) and
Education Code Section 8328 except that if the contractor does not
have a governing board, the chief executive officer shall establish
the fund.
C. Enrollment and Attendance Accounting
All contractors providing direct services shall use daily sign -in,
sign -out sheets as a primary source document for audit and
reimbursement purnoses. All subsidized children sIvi.11 he signed in and out
(no initials) at the times of arrival and departure with the times clearly indicated.

Each month the contractor shall compare service agreements with
the parent(s) to the child's actual attendance (including excused

documentation of the mailing date shall be retained by the
contractor..
2. Tf the fees are still_ unpaid two (2) weeks following the elate of
the Notice, the contractor may terminate services. A six-month
period of ineligibility may follow termination of services when
the cause of termination is failure to pay fees.
3. The contractor may accept a reasonable plan from the parent for
payment of delinquent fees. Services may continue, provided
current fees are paid and provisions of the delinquent fee
payment plan are met.
VT. 0THFR RMTJIREMFNTS
A. Publications
Contractors or subcontractors who use contract funds to develop
materials For publication shall, prior to publication, submit the
materials to the CDD for review. When published, all such materials
shall include a statement that the publication was funded, in whole or
in }part, with funds from the SDF but that the author is solely
responsible for the content. Within thirty (30) days of publication
t -he contractor shall forward one (T) complementary copy of the
publication to the CDD.
Materials developed in whole or in part with contract funds (including
such things as brochures, handbooks and computer software) shall
rem-iin in tho public domain and shall not be sold for profit.
R. Staff Qualifications --Program Director
The contractor shall employ a program director who has overall
administrative responsibility for programs operated at one or more sites.
The director may also serve as a site supervisor at one of the sites if the
person assumes responsibility for the day-to-day operation of the program.
The program director shall hold one of the following valid permits or
credentials issued by the Ccarmission on Teacher Credentialing.

C. Staff Qualifications - Program Director for Recreational Programs Only

Raccalaureate Degree in recreation, recreational therapy, special
education, or a related .field; three (3) semester units of administration
and supervision of child development programs; and two (2) years of
teaching or supervisory experience in .recreational programs.program.

n. Staff nuaIi flicat ions --Site Supervisor
Each site, whether or not it is exempt .from licensure, must have a fully
qualified supervisor, responsible for program operations, on the premises
during the hours the program is in operation. The site supervisor shall
meet one of the following:
1. Hold a high school diploma or GED; twelve (12) semester units in early
childhood education/child development, elementary education, or
physical edification and recreation (at least fifty percent (50%) of the
units must be ECE/CD); four (4) years' experience in ECT/CD programs;
three (3) semester units in program administration or staff relations.
2. Hold an A.A. degree from an accredited college with a major in early
childhood education/child development; two (2) years' teaching
experience in FCR/CD programs; three (3) semester units or equivalent
darter units in administration or staff_ relations. The units earned
tawa.r(l the A.A. degree may be a combination of ECF,/Cn, recreation
and/or elementary education with at least fifty percent (50%) F.CE/cam.
3. Hold a baccalaureate degree from an accredited college or university
with a rrti-rjor in early childhood education/child development; at least
one year of teaching experience in ECF,/CD programs; three (3) semester
units or equivalent quarter units in administration or staff
relations. The units earned toward the baccalaureate degree may be a
combination of FCR/c?), recreation and/or elementary education with at
least fifty percent (50%) FCF,/CD.

equivalent quarter units are completed.
2. Have twelve (12) semester units or equivalent quarter units in early
childhood education or child development from an accredited or approved
college or university and at least six (6) months' work experience in a
licensed child care center or comparable group child care program.
3. Hold a Children's Center Instructional Permit (various types)
4. Re deemed to hold a permit pursuant to Education Code Section 8360.
F. Staff Qualifications --Teacher in Recreational Component
4 teacher in a recreational program or who teaches only in the recreational
component of a program that includes educational components shall meet one
of the following:
1. Twelve (12) post -secondary sermster units or equivalent quarter units
from an accredited college or university which may be a mix of early
childhood education, child development, or recreational and physical
education units earned toward attainment of an Elementary Credential
(Multiple Subjects Credential.) or a physical education major, and six
(G) months' instruc-tional experience (paid or volunteer as an aide or
teacher in a licensed child care center or recreational program.
9. Any option indicated for Teacher under VI.D. above.

For both educational and recreational components the staffing ratio is:

presented for your information is a summary of changes to the Fundinq Terns
and Conditions (FT&C) and Program Requirements included with the COLA
amendrrent. These changes are reflected as language changes on the enclosed
amendment facesheet, and the appropriate revised pages are attached for
insertion in the FT&C and program Requirements (as applicable) distributed with
your original 19A6/87 contract.
The highlights are as .follows:
I. Change to the Funding Terms and Conditions.
The Fnrol.lment and Attendance Accounting section has been amended to
read:

indicated. If the child is not dropped off/picked up by a parent
or ntller adult, a contractor designated staff person shall sign
the c=hild in and out.
?. Change on page 1.0 of the Migrant program requirements.
After issuance of the contracts, a typographical error in the staffing
ratios was discovered. The correct teacher:child ratio for infants
and torldlers should be 1:16, not 1:24.
3. Changes on page 9 and 1D Latchkey program requirements.
Staffing qualifications have been updated consistent with proposed
Title 22 regulations and director of recreational programs has been
added.
4. Documr mutation Requirements for. In -Horne Care.
The County Welfare Department, Child Protective Services, Alternative
payment and School Age Community Child Care Alternative Payment
program Requirements contain a section describing the information that
the contractor must have on file for caregivers providing services in
the child'shome. The existing language reads:
2. A physician's statemept that the caregiver is free of
communicable diseases and emotionally capable of caring for
children.

3. For nonrelatives, the names, addresses and telephone numbers
of tzvo character references to be contacted by the
contractor.
This language is changed to read:
2. A provider's written self -declaration of good health.
3. A signed written statement from the parent that the parent
has interviewed the provider and checked references.
5. Family Child Care Home operations.
For center program contractors also providing family child care home
services, a sentence has been added clarifying that the staffing
qualifications and ratios in the Program Requirements and the Program
Quality Requirements do no apply to Family Child Care Home operations.
