RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
DENYING WITHOUT PREJUDICE AN APPEAL OF
THE PLANNING COMMISSION'S DENIAL OF A USE PERMIT
FOR RETAIL SALES AT 30 CASTRO AVENUE
WHEREAS, on January 6, 1986, the City Council considered
the appeal of a Planning Commission denial without prejudice
for retail sales at 30 Castro Avenue; and
WHEREAS, the applicant was represented butdid not speak
regarding the appeal.
NOW, THEREFORE, BE IT RESOLVED that the City Council
upholds the Planning Commission denial without prejudice of
the retail sales use permit for the following reasons:
(1) The proposal is inconsistent with the site's Office/
Industrial land use designation in the draft East
San Rafael Neighborhood Plan and is therefore prejudicial
to the Plan's outcome. Approval of the use would
require a revision to the proposed land use designation
for the site and surrounding properties, as well
as additional traffic allocations to the site and
surrounding properties, decisions which should be
made by City Council adoption of a neighborhood plan
for East San Rafael.
(2) The applicant -recommended General Retail land use
designation for this and surrounding properties would
not be consistent with the public health, safety
and general welfare in that it would result in an
intensification of use, causing greater traffic impacts
near the Bellam interchange and would be inconsistent
with draft East San Rafael Neighborhood Plan policies
(6.1.3, 4.1.5 and 6.1.7) to limit non -local serving
retail expansion due to the need to conserve traffic
capacity for more important land uses.
(3) The applicant -recommended General Retail land use
designation for the adjacent east Castro Avenue parcels
is also not appropriate because these properties
are not overall suited for intensive retail uses.
Existing projects were designed and built as office/
industrial buildings with limited parking (see sheet
1 of 2 of graphics) which limit hours of operation
to after 6:00 p.m.
(4) The applicant -proposed traffic mitigation measures
are not reasonable, would be impossible for City
staff to monitor effectively and do not address the
basic issue of the inappropriateness of general retail
use at this location.
