A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DIRECTING STAFF TO FILE A NOTICE OF MERGER
ON CERTAIN REAL PROPERTY AT 124 ROSS STREET
(AP 12-142-30, formerly AP 12-142-27 and 28)
WHEREAS, on January 6, 1986, the owner of the subject
property was sent by certified mail a Notice of Intention to
Record a Notice of Violation of the Subdivision Map Act on
the above -noted property; and
WHEREAS, this Notice of Intention identified a Planning
Commission meeting date of February 11, 1986, at which this
item would be scheduled and reviewed; and
WHEREAS, the Planning Commission determined that
a Notice of Violation would not be recorded if the subject
parcels were merged and with the owner's concurrence so recommended
to the City Council; and
WHEREAS, the City Council has determined that the
above noted property is subject to merger under Section 15.10.010
of the City of San Rafael Municipal Code because of the following
reasons:
(a) The subject property consists of two contiguous parcels
in common ownership, and one of them is less than
the 5,000 square feet minimum required;
(b) One of the parcels is not developed with a building
for which a permit has been issued by the City.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council identifies a lot merger on the subject property
and directs staff to file a Notice of Merger legally merging
County Assessor's Parcel numbers 12-142-27 and 12-142-28 in
accordance with Section 15.10.020 of the San Rafael Subdivision
Ordinance.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Monday , the Third day of March ,
1986, by the following vote, to wit:
