RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
RESCINDING RESOLUTION NO. 7096,
CERTIFYING A NEGATIVE DECLARATION AND
RESOLVING THE INTENT OF THE CITY COUNCIL
TO AMEND THE SAN RAFAEL GENERAL PLAN
BY ADOPTING THE NORTH SAN RAFAEL POLICY PLAN
WHEREAS, after a lengthy public review process before
the Planning Commission and the City Council, the San Rafael
City Council adopted Resolution No. 7096, a Resolution of Intent
to Certify a Negative Declaration and to Amend the San Rafael
General Plan by Adopting the North San Rafael Policy Plan,
on May 6, 1985 (3-2, Frugoli and Nave dissenting); and
WHEREAS, since that time the Countywide Plan Advisory
Committee, the Marin County Planning Commission and the Marin
County Board of Supervisors have reviewed the draft North San
Rafael Policy Plan at appropriately noticed public hearings;
and
WHEREAS, the Board of Supervisors has formally requested
that the City Council rescind its Resolution of Intent for
the reasons specified in the attached January 31, 1986 letter
from Board Chairman Gary Giacomini; and
WHEREAS, the San Rafael Planning Commission considered
the Board of Supervisors' request at a duly noticed public
hearing on March 11, 1986, and then unanimously (6-0, Smith
absent) recommended to the City Council that it rescind its
Resolution No. 7096.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council hereby rescinds it Resolution No. 7096, which
was a Resolution of Intent to Certify a Negative Declaration
and to Amend the San Rafael General Plan by Adopting the North
San Rafael Policy Plan for the following reasons:
(1) The Highway 101 Corridor Study has provided new information
about the extent and nature of the commute congestion
which would be affected by the development of this
area; and
(2) New population, employment and housing projections
by ABAG show trends in Marin County that were not
considered in developing this draft Plan; and
(3) The Plan's budget did not allow preparation of an
Environmental Impact Report, which meant that some
very difficult environmental issues, e.g., development

in Bay front areas, balancing of land use with circulation
improvements, relationship of the North San Rafael
Policy Plan to the Northgate Activity Center, etc.,
were not properly addressed; and
(4) The City will be considering new land use designations
and density/intensity designations for the North
San Rafael area in its ongoing General Plan revision.
Additionally, Marin County will be reacting to the
City General Plan revision and its own policy needs
in an upcoming Marin Countywide Plan update.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Monday , the Seventh day of April
1986, by the following vote, to wit:
