A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
FINDING UNITED AMBULANCE SERVICE TO BE LOCATED
AT 1314 LINCOLN AVENUE IN VIOLATION OF THE
SAN RAFAEL ZONING ORDINANCE
WHEREAS, on or about May 3, 1985, United Ambulance
Service located its ambulance station at 1314 Lincoln Avenue;
and
WHEREAS, the San Rafael Zoning Ordinance allows ambulance
service use in the C-2 (General Commercial), C-4 (Downtown
Commercial) and M (Heavy Commercial and Manufacturing) Districts
and only upon approval of a use permit; and
WHEREAS, the Planning Director has determined that
ambulance service use may be allowed by use permit in the P -C -M
(Planned Commercial and Light Industrial) District; and
WHEREAS, 1314 Lincoln Avenue is zoned R-4 (Transient
Residential) District, which includes no provision for ambulance
service use; and
WHEREAS, numerous neighbors of 1314 Lincoln Avenue
have testified and written that United Ambulance Service operates
an ambulance station at 1314 Lincoln Avenue which results in
noise and light nuisances infringing on the residential use
and privacy of said surrounding residential properties.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council hereby finds that United Ambulance Service operates
an ambulance service at 1314 Lincoln Avenue, in violation of
the San Rafael Zoning Ordinance.
BE IT FURTHER RESOLVED that consistent with Section
14.96.020 of the Municipal Code, the City Council hereby directs
the City Attorney to commence action or proceedings for the
abatement and removal of United Ambulance Service at 1314 Lincoln
Avenue unless United Ambulance Service has vacated the premises
by September 15, 1985.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Monday , the Fifth day of August
1985, by the following vote, to wit:
