RESOLUTION NO. 7194
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council adopts an amendment to the Urban Design and Development
Policy Statement for East San Rafael for the residential project
referred to as "Spinnaker on the Bay" and the findings as follows:
The amendment to the Urban Design and Development
Policy Statement for East San Rafael would permit
an all -residential use without filling of the lagoon
and wetland areas. After a thorough review of environmental
issues, it was determined that the amendment is justified
in that the present policy statement designation
for marina, residential and commercial uses is inappropriate.
A marina project has the potential to create unavoidable
adverse environmental impacts. Additionally, the
amendment promotes residential development in East
San Rafael and encourages a balance of needed land
uses.
