HomeMy WebLinkAboutCC Resolution 7194 (Spinnaker on the Bay)RESOLUTION NO. 7194 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ADOPTING AN AMENDMENT TO THE URBAN DESIGN AND DEVELOPMENT POLICY STATEMENT FOR EAST SAN RAFAEL FOR SPINNAKER ON THE BAY DEVELOPMENT ON COUNTY ASSESSOR'S PARCELS 9-010-17, 18, 19, 20, 21; 9-100-01, 04, 05; AND 9-142-13, 24, 26, 53 WHEREAS, in 1982 the Planning Department reviewed an application for amendment to the Urban Design and Development Policy Statement for East San Rafael for a 696 unit residential and commercial development on the subject property involving major filling of existing lagoon and wetland areas; and WHEREAS, the present General Plan designation is Residential and Open Space Review Area but the Urban Design and Development Policy Statement for East San Rafael designates the site for residential, commercial and inboard marina use; and WHEREAS, after consultation with many agencies and organizations, an initial environmental study was prepared and presented to the Planning Commission in April 1983, recommending preparation of a focused environmental impact report; and WHEREAS, draft and final environmental impacts reports certified by the City Council on November 19, 1984, were prepared in accordance with the California Environmental Quality Act and concluded that the initial project has the potential to result in unavoidable adverse environmental impacts; and WHEREAS, the project has been significantly modified to address a number of unavoidable adverse impacts, reducing such impacts to acceptable levels; and WHEREAS, the project has been reviewed for consistency with the draft East San Rafael Neighborhood Plan and after detailed review of neighborhood issues, it has been determined that the project is not prejudicial to the Plan process and that an all -residential development as proposed is appropriate for the site. RESOLUTION NO. 7194 NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council adopts an amendment to the Urban Design and Development Policy Statement for East San Rafael for the residential project referred to as "Spinnaker on the Bay" and the findings as follows: The amendment to the Urban Design and Development Policy Statement for East San Rafael would permit an all -residential use without filling of the lagoon and wetland areas. After a thorough review of environmental issues, it was determined that the amendment is justified in that the present policy statement designation for marina, residential and commercial uses is inappropriate. A marina project has the potential to create unavoidable adverse environmental impacts. Additionally, the amendment promotes residential development in East San Rafael and encourages a balance of needed land uses. I, JEANNE M.
