RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL AUTHORIZING THE SIGNING OF
RIGHT OF WAY CERTIFICATION DOCUMENTS FOR
FEDERAL AID PROJECTS
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY
RESOLVES as follows:
The Director of Public Works/City Engineer is hereby
authorized to execute on behalf of the City of San Rafael Right of
Way Certification documents for Federal Aid projects which involve
construction within existing Right of Way.
Said Certification documents shall conform to the
California Department of Transportation "Local Programs Manual",
Volume I, Section 14. A copy of said document is attached hereto,
marked Exhibit "A", and incorporated by this reference.
I, JEANNE M. LEONCINI, City Clerk of the City of San
Rafael, California, hereby certify that the foregoing resolution was
duly and regularly introduced and adopted at a regular meeting of
the Council of said City held on the 7th day of October, 1985, by
the following vote, to wit:
AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave, Russom & Mayor Mulryan
NOES: COUNCILMEMBERS: None

(1) This will be a State administered project and the
high and low risk underground facilities meet
Caltrans requirements for minimum clearance.

(2) This will be a locally administered project and I
certify that (Local Agency) has been informed in
writing of Caltrans high and low risk underground
facilities policy. I am aware that the State
assumes no liability for compliance or non-
compliance with said policy.

8. COMPLIANCE WITH FEDERAL AND STATE REQUIREMENTS REGARDING THE

The acquisition of right of way was not required.
9. COMPLIANCE WITH RELOCATION ADVISORY ASSISTANCE AND PAYMENTS
PROVISIONS OF FEDERAL AND STATE LAW
The project did not require the displacement of any persons
or business.
I HEREBY CERTIFY the right of way on this project as conforming to
Statement No. (J_) of Paragraph 5c of FHPM 6-4-2-1.
