RESOLUTION FINDING AND DETERMINING THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION AND
CONSTRUCTION OF THE IMPROVEMENTS
EAST FOURTH STREET PARKING ASSESSMENT DISTRICT
The City Council of the City of San Rafael resolves:
A public hearing for which notice has been given by
publication, posting and mailing, has been held as to the public
convenience and necessity of the acquisition and construction of
the improvements in East Fourth Street Parking Assessment
District, City of San Rafael, Marin County, California.
This Council has heard and considered all the evidence,
both oral and written, relative to the public convenience and
necessity of the construction of improvements, and finds that the
public convenience and necessity require the following
improvements proposed to be acquired and constructed in East
Fourth Street Parking Assessment District, City of San Rafael,
Marin County, California:
The acquisition of the real property commonly known as
519 Fourth Street, San Rafael, California, presently
containing the Marin County Garage, the demolition of
the existing structures thereon, and the construction or
installation of all works and improvements to make a
complete parking lot thereon, including, but not limited
to, grading, paving, striping, landscaping, parking
meters, and all other appurtenances necessary thereto.
If the City can negotiate appropriate easements, the
assessment shall cover cost of a walkway to be
constructed over parcel nos. 14-123-15 and 14-123-16
connecting Third Street to lot 14-123-07, and a walkway
over that lot to parcel 14-123-06. This assessment also
covers the cost of placement of parking meters where the
City deems appropriate along streets in the vicinity of
the parking lot within the area between Mission Street
on the North, Second Street on the South, Lincoln Avenue
on the West, and Union Street on the East, and covers
the acquisition cost of necessary parking enforcement
equipment.
and further determines that the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 shall not apply to
these assessment proceedings and that this project shall proceed
in accordance with the terms and provisions of the Municipal
Improvement Act of 1913.

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 21st day of October, 1985, by the
following vote, to wit:
