RESOLUTION OF INTENTION TO AMEND THE PROCEEDINGS IN
CIVIC CENTER — NORTHGATE ASSESSMENT DISTRICT
IN THE MATTER OF THE WORK TO BE DONE, PROPOSED BOUNDARIES,
COSTS THEREOF, THE ASSESSMENTS TO BE LEVIED,
BOND PROVISIONS AND DIRECTING THE FILING OF AN
AMENDED ENGINEER'S REPORT
The City Council of the City of San Rafael resolves:
Pursuant. to Section 10352 of the California Streets and
Highways Code, it is the intention of this City Council to amend the
proceedings in Civic Center - Northgate Assessment District, City of
San Rafael, Marin County, California, as follows:
1. To amend Resolution of Intention No. 6811, adopted by
this Council on May 7, 1984, as to the description of work by adding
the following:
A. Construction of a sanitary sewer pumping station to be
located adjacent to and northwesterly of the Northwestern
Pacific Railroad right of way approximately 1,800 feet
northeasterly from Civic Center Drive.
B. Construction of approximately 2,250 feet of force main
from said pumping station northeasterly along said
railroad right of way and crossing same to connect. with
Las Gallinas Valley Sanitary District "Mulligan" force
main.
C. The acquisition of all necessary interests in real
property.
The construction of a public street, Avesta Drive, from
Civic Center Drive northeasterly for a distance of
approximately 2,900 feet and the widening of Civic Center
Drive including clearing, grading, subbase, base,
pavement, curbs and gutters, sidewalk, pedestrian/bicycle
path, storm drainage facilities, sanitary sewers and
appurtenances; a system of domestic water supply including
fire hydrants and other appurtenances; street lights and
underground electrical, gas, telephone and cable
television facilities; and all other improvements and
facilities necessary for completion of the street
improvements, and the acquisition of all necessary
interests in real property.
2. By revising the boundaries of the district to include
the area shown on the map entitled, "Amended Boundaries, Civic
Center - Northgate Assessment District, City of San Rafael, State of
California." This amended map has been approved by the City Council
and is now on file with the City Clerk.
3. By deleting the bond paragraph on page 2 and
substituting therefor the following:
ORIGINAL
Serial bonds representing unpaid assessments, and bearing
interest at a rate not to exceed twelve percent. (12%) per
annum, will be issued in the manner provided by the
Improvement Bond Act of 1915 (Division 10, Streets and
Highways Code), and the last installment of the bonds
shall mature not to exceed nineteen (19) years from the
second day of September next succeeding twelve (12) months
from their date.
This Council hereby directs the Engineer of Work to file
an Amended Engineer's Report including an amended assessment
diagram, a revised engineer's estimate of cost, an amended
assessment roll, revised property owners list, and a statement of
method of allocating benefit to reflect changes in the work to be
done, the costs thereof and the assessments to be levied.
Notice is hereby given that Monday, December 16, 1985, at
8:00 p.m., in the Chambers of the City Council, 1400 Fifth Avenue,
San Rafael, California, shall be the time and place when and where
the City Council will consider and determine whether the proceedings
shall be amended as stated above.
Tie City Clerk is authorized and directed to publish this
resolution once, with publication to be at least ten (10) days prior
to the date of the hearing; and is further directed to cause a copy
of this resolution to be mailed to the owners of all of the
properties located within the amended boundaries of this district,
said notice to be mailed at least. twenty (20) days prior to the date
of the hearing.

California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 18th day of November, 1985, by the
following vote, to wit:
