HomeMy WebLinkAboutCC Resolution 7249 (Civic Center-Northgate Assessment District)RESOLUTION NO. 7249 RESOLUTION FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENTS CIVIC CENTER - NORTHGATE ASSESSMENT DISTRICT The City Council of the City of San Rafael resolves: A public hearing for which notice has been given by publication, posting and mailing, has been held as to the public convenience and necessity of the construction of the additional improvements in Civic Center - Northgate Assessment District, City of San Rafael, Marin County, California. This Council has heard and considered all the evidence, both oral and written, relative to the public convenience and necessity of the construction of the improvements, and finds that the public convenience and necessity require the following improvements proposed to be constructed in Civic Center - Northgate Assessment District. A. Construction of a sanitary sewer pumping station to be located adjacent to and northwesterly of the Northwestern Pacific Railroad right of way approximately 1,800 feet northeasterly from Civic Center Drive. B. Construction of approximately 2,250 feet of force main from said pumping station northeasterly along said railroad right of way and crossing same to connect with Las Gallinas Valley Sanitary District "Mulligan" force main. C. The acquisition of all necessary interests in real property. and further determines that the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not apply to these assessment proceedings and that this project shall proceed in accordance with the terms and provisions of the Municipal Improvement Act of 1913. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City held on the 16th day of December, 1985, by the following vote, to wit: AYES: COUNCILMEMBERS:Breiner, Frugoli, Nave, Russom & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS:None /h - JE t M.
