A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DISPENSING WITH THE COMPETITIVE BIDDING AND AUTHORIZING
A SOLE SOURCE PURCHASE OF ONE STREET SWEEPER
WHEREAS, the San Rafael City Charter requires the purchase
of equipment in excess of $5,000 be competitively bid;
and
WHEREAS, the Public Works Director has presented a report
to the City Council that one street sweeper be purchased directly
from the manufacturer without proceeding to a formal bid process;
and
WHEREAS, the reasons for this request are outlined in his
report to the City Council of this date, and are summarized
as follows:
1. Competitive bids were sought by Walnut Creek.
2. We would have sent the same set of specifications
to the same manufacturers.
3. We have specified the exact same machine as Walnut
Creek.
WHEREAS, the City Attorney indicates that where competitive
bidding would be unavailing the Council may dispense with the
formal bid process and authorize sole source purchase of a street
sweeper.
NOW, THEREFORE, BE IT RESOLVED that the competitive
bidding of one street sweeper is hereby dispensed with.
BE IT FURTHER RESOLVED that the City staff is authorized
to proceed with a sole source purchase.
