RESOLUTION CALLING FOR CONSTRUCTION BIDS
KERNER BOULEVARD ASSESSMENT DISTRICT
The City Council of the City of.San Rafael resolves:
1. This City Council has given preliminary approval to
the plans and specifications prepared by the Engineer of Work for
the underground gas, electric and telephone facilities in the Kerner
Boulevard Assessment District.
2. The City of San Rafael will receive sealed proposals
for this construction not later than 2:00 P.M. on April 25, 1985, in
the office of the City Clerk located at 1400 Fifth Avenue, San
Rafael, California 94902. At that time and place the sealed
proposals will be publicly opened, examined and declared.
3. The City Council reserves the power in its discretion
to reject all proposals. The award of construction contract, if
made, shall be made to the lowest responsible bidder within the time
fixed in the specifications (or any extension of time agreed to by
the City and the lowest responsible bidder).
4. The City Clerk is directed to publish a notice
inviting sealed proposals in the INDEPENDENT JOURNAL, in accordance
with the Municipal Improvement Act of 1913. The Engineer of Work is
authorized to give additional notice and to distribute additional
information as necessary in the judgment of the Engineer of Work, to
secure competitive bidding.

California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 18th day of March, 1985, by the
following vote, to wit:

NOTICE INVITING SEALED BIDS
UNDERGROUND GAS, ELECTRIC AND
TELEPHONE FACILITIES
KERNER BOULEVARD ASSESSMENT DISTRICT
The City Council of the City of San Rafael invites sealed bids for the
construction of underground gas, electric and telephone facilities in the Kerner
Boulevard Assessment District, City of San Rafael, Marin County, California.
The improvements are generally described as follows:
The trenching and backfill for a 6 -inch gas main along Francisco
Boulevard from a point 920 feet, more or less, [Fest of Pelican Way easterly
to Pelican Way and northerly along Pelican Way to Kerner Boulevard.
Trenching, installation of electrical and telephone conduits, splice
boxes and backfilling after gas lines are installed by others.
Plans and specifications for the work may be obtained at the office
of the Project Engineer, Oberkamper & Associates, 10 Paul Drive, San Rafael,
California, upon deposit of $25.00 per set, which is non-refunclablc.
The contractor for the work will be required to pay the general
prevailing rates of wages as determined by the Driector of the Department
of Industrial Relations of the State of California. A copy of these rates is
Oil file with the City Clerk, and is available on request.
Bids must be accompanied by cash, a cashier's check or a certified
check amounting to ten percent (.10%) of the bid, payable to the order of the
City Clerk, or by a bond for that amount signed by the bidder and two sureties
(who shall justify before any officer competent to administer an oath, in double
that amount, and over and above all statutory exemptions) or by a corporate
surety bond to the satisfaction and approval of the Public Works Director.
The City Council reserves the right to reject all bids in its discretion,
and to reject the bid of any bidder who has been clelincluent or unfaithful in any
furmer contract with the City of San Rafael. The contract, if let, will be awarded
under the authority of the Municipal Improvement Act of 1913 of the State of
Californi;.► and subject to its provisions.
The contractor will be paid in cash in accord;incc with the specifications
from the improvement fund for Kerner Boulevard Assessment District, City of San
Rafael, Marin County, California.

Sealed bids must be delivered to they office of the City Cleric of the
City of San Rafael at 1400 fifth Avenue, San Rafael, Californi,i, b(•fore 2:00
P.M. on Thursday, April 25,1985. At that time, all bids will be publicly
opened, examined and declared.
The contract, if let, will be awarded to the lowest responsible bidder
by the City Council at a subsequent time, but within the time set forth in the
specifications.
The contractor may elect to receive• 1001;; of payments clue under the
contract from time to time, without retention of any portion of the payment by
the City, by depositing securities of equivalent value with the City in accordance
with the provisions of Section 4590 of the Government Code. Such securities, if
deposited by the contractor, shall be valued by the City's Finance Officer, whose
decision on valuation of the securities shall be final.
