HomeMy WebLinkAboutCC Resolution 7061 (Jewell Street Cert of Compliance)RESOLUTION NO. 7061 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL GRANTING APPROVAL OF A CERTI- FICATE OF COMPLIANCE FOR ASSESSOR'S PARCEL NUMBER 14-024-04, JEWELL STREET THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: WHEREAS, the application has been received for Certifi- cate of Compliance for Assessor's Parcel 14-024-04, Jewell Street; and WHEREAS, City Staff has determined that the subject lot is commonly owned with Assessor's Parcel Number 14-024-06, 279 Union Street, and is subject to merger pursuant to the City's Merger Ordinance (15.10 of the Municipal Code) because the lot is undeveloped and substandard in terms of width by virtue of the City's Slope Ordinance (15.32 of the Municipal Code); and WHEREAS, the Certificate was referred to the City Council which, pursuant to the Merger Ordinance, is charged with the responsibility of hearing evidence and making determinations regarding lot mergers; and WHEREAS, the City Council held a duly noticed public meeting on the requested Certificate and concluded that the Certificate should be granted and the properties not merged because: 1. The subject parcel was legally created and meets the minimum area requirements of the Zoning and Slope Ordinances. 2. Although the subject parcel is less than the minimum width required by the Slope Ordinance for a parcel of its slope, Section 15.34.020(c) of the Slope Ordinance provides for allowance of a lot of lesser width than required, if it can be demonstrated that a reasonable and realistic access to an adequate building site exists. The City Engineer has deter- mined and adjacent single family development demon- strates that such reasonable and realistic access to an adequate building site exists. RESOLUTION NO. 7C,v1 3. Merger would serve no useful purpose in that merger would create a split -zoned parcel, the vacant portion of which could still be developed but not sold separately. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby directs City staff to issue a Certificate of Com- pliance for Assessor's Parcel Number 14-024-04, Jewell Street, upon the following findings of fact and with condition (a) as noted below: 1. The subject parcel was legally created and meets the minimum area requirements of the Zoning and Slope Ordinances. 2. Although the subject parcel is less than the minimum width required by the Slope Ordinance for a parcel of its slope, Section 15.34.020(c) of the Slope Ordinance provides for allowance of a lot of lesser width than required, if it can be demon- strated that a reasonable and realistic access to an adequate building site exists. (a) Four parking spaces shall be provided on-site to the satisfaction of the Planning Department and shall be indicated on the plans submitted for building permit approval. (b) The site plan submitted for a building permit shall indicate on-site turnaround capability to the Planning Director's satisfaction. - 2 - RESOLUTION NO. 7L 1 I, JEANNE M.
