RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL ACCEPTING CONVEYANCE
OF REAL PROPERTY AND AUTHORIZING EXECU-
TION OF RIGHT-OF-WAY CONTRACT - KERNER
BOULEVARD ASSESSMENT DISTRICT, SAN RAFAEL,
CALIFORNIA (A.D. NO. 24)
WHEREAS, the public interest, convenience, necessity and
welfare require that the real property hereinafter mentioned be
accepted and used for the benefit of the public of the City of San
Rafael, California;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of San Rafael, California, does hereby accept that certain
deed for and on behalf of the City of San Rafael and the real property
described therein, all as more particularly described and set forth in
the attachment hereto and incorporated herein by reference, and said
deed is to be duly recorded in the Office of the County recorder of
the County of Marin, State of California, forthwith upon the adoption
of this resolution and close of escrow.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
authorized to execute, on behalf of the City of San Rafael, the right-
of-way contract with Marin County Employees Retirement Association,
a pension fund, which specifically sets forth the terms and conditions
of said conveyance.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council
of said City held on the 15th day of April, 1985 by the following
vote, to wit:

All that certain real property situate in the City of San Rafael, County of Marin,
State of California, described as follows:
PARCEL ONE
Beginning at the most northerly corner of PARCEL ONE of that certain map
entitled "Land Division of the Lands of Samuel W. Gardiner, San Rafael, California",
recorded December 23, 1975 in Volume 12 of Parcel Maps at Page 14A, Marin County
Records, at the intersection of the courses "North 38046'00" East, 421.25 feet" and
"South 51014100" East, 320.00 feet", as shown thereon (12 PM 14A) which lies on
the southwesterly boundary of the parcel described in deed from Samuel W. Gardiner
to City of San Rafael, a municipal corporation, recorded January 9, 1976 in Volume
2981 of Official Records at Page 493, Marin County Records; thence along the common
boundary between said PARCEL ONE (12 PM 14A) and said City of San Rafael parcel
(2981 OR 493) South 52027118" East, 25.00 feet; thence leaving said common boundary
(12 PM 14A and 2981 OR 493) westerly along a curve to the left, whose center bears
South 37032142" West, having a radius of 25.00 feet through a central angle of 90000'00"
an arc length of 39.27 feet to the northwesterly boundary of said PARCEL ONE
(12 PM 14A) ; thence along said northwesterly boundary (12 PM 14A) North 37°32'42''•
East, 25.00 feet to the point of beginning.
Containing 0.0031 acres more or less.

Beginning at the most westerly corner of PARCEL ONE of that certain map entitled
"Land Division of the Lands of Samuel W. Gardiner, San Rafael, California", recorded

at the intersection of the courses "South 14000100" East, 320.00 feet" and "North
38046'00" East, 421.25 feet", as shown thereon (12 PM 14A) ; thence along the north-
westerly boundary of said PARCEL ONE (12 PM 14A) North 37032'42" East, 25.00
feet; thence leaving said northwesterly boundary (12 PM 14A) southerly along a curve
to the left, whose center bears South 52027'18" East, having a radius of 25.00 feet
through a central angle of 90°00100", an arc length of 39.27 feet to the exterior
