RESOLUTION AWARDING CONTRACT
KERNER BOULEVARD ASSESSMENT DISTRICT
The City Council of the City of San Rafael resolves:
The City of San Rafael has received public bids for the
the construction of underground gas, electric and telephone
facilities in the Kerner Boulevard Assessment District.
The Engineer of Work has reviewed the bids and now
recommends award of the construction contract to the lowest
responsible bidder, Community Electric, Inc., whose bid price is
$382,500.00.
The City Council therefore awards the contract to that
bidder. All other bids are rejected.
The City Council directs the City Clerk to publish a
notice of award of contract.
The City Council authorizes and directs the Mayor and the
City Clerk to sign the written contract for this construction when
it is presented to them for signature, along with the surety bonds
and insurance certificates required by the construction
specifications.

California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 6th day of May, 1985, by the

CONSTRUCTION AGREEMENT
This is an agreement between the CITY OF SAN RAFAEL (the
"public agency") and CONiNIUNITY ELECTRIC, INC. (the "contractor").
This agreement is made under the authority of the Municipal
Improvement Act of 1913 of the State of California (Section 10000
and following, Streets and Highways Code).
The public agency has taken special assessment proceedings
under the Municipal Improvement Act of 1913 and has awarded a
contract to the contractor for the construction of underground gas,
electric and telephone in the Kerner Boulevard Assessment District,
City of San Rafael, Marin County, California.
THEREFORE, in consideration of the mutual promises set
forth herein, the parties agree as follows:
1. The agreement between the public agency and the
contractor shall consist of this document together with the
following documents, which are on file with the Clerk of the public
agency and are incorporated herein by reference.
a. The report prepared pursuant to Section 10204 of the
Streets and Highways Code and approved by the
legislative body of the public agency; the report
includes plans and specifications covering the work to
be done under this agreement.
b. Notice Inviting Sealed Bids for construction bids for
the work to be done under this agreement.
C. The proposal submitted to the public agency by the
contractor.
2. The contractor agrees to construct and install, in a
good and workmanlike manner, the improvements described in the plans
and specifications and in the contractor's proposal. The contractor
shall furnish all tools, equipment, labor and materials required to
complete the improvements. The work shall be done strictly in
accordance with the plans and specifications, and the materials used
shall meet the standards prescribed therein.
3. The public agency agrees to pay the contractor for
work actually performed at the following unit prices. The
quantities of work stated herein are estimates only; actual
quantities will be measured for payment in accordance with the
specifications.
The construction of underground gas, electric and
telephone improvements in the Kerner Boulevard Assess-
ment District, for the lump sum price of Three Hundred
Eighty -Two Thousand, Five Hundred and no/100 Dollars

In accordance with Section 2-08 (b), General Provisions, the
Contractor agrees to accomplish the work for the Type (2)
trenches at the following unit price per lin. foot,
Forty-seven Dollars ($47.00) per lineal foot.
4. The contractor will be paid in cash, but only from the
improvement fund for the special assessment district named above.
The time of payment shall accord with the specifications.
5. Time For completion of the work is fixed in the
specifications. If the contractor fails to complete, the work within
the time limit, the contractor shall become liable to the public
agency for liquidated damages in the amount of $100 per day, unless
the contractor is granted a time extension, all as set forth in the
specifications.
6. The contractor shall secure the payment of
compensation to his employees in accordance with Section 3700 of the
Labor Code of the State of California, as required by Labor Code
Section 1860.
7. This is a public works contract within the meaning of
Part 7 of Division 2 of the California Labor Code (Sections 1720 and
following), and the contractor and any subcontractor under him shall
pay not less than the specified prevailing rates of wages to all
workmen employed.
