RESOLUTION OF INTENT BY THE SAN RAFAEL CITY COUNCIL
TO CERTIFY A NEGATIVE DECLARATION AND
TO AMEND THE SAN RAFAEL GENERAL PLAN BY ADOPTING
THE NORTH SAN RAFAEL POLICY PLAN
WHEREAS, in February 1982 the San Rafael City Council
and Marin County Board of Supervisors approved a Memorandum
of Understanding for preparation of the North San Rafael Policy
Plan with grant funding from the San Francisco Foundation and
in-kind services from the City and County; and
WHEREAS, in April 1982 Sedway/Cooke Associates was
selected as Plan consultant with Robert Harrison and Lynn Sedway
Associates as subconsultants; and
WHEREAS, a Technical Coordinating Committee comprised
of representatives of Federal, State and local agencies and
property owners was formed and "Phase I, Summary of Findings"
and "Phase II, Alternatives" reports were distributed for public
review in May and July, 1982, respectively; and
WHEREAS, the "Refinement and Evaluation of Alternatives"
report was issued in August 1982 after San Rafael Planning
Commission consideration of the Phase I and II reports, with
the San Rafael Planning Commission recommending and the San
Rafael City Council approving a preferred alternative in September
1982; and
WHEREAS, the Draft North San Rafael Policy Plan with
Appendices A and B was distributed for public review in November
1982; and
WHEREAS, the San Rafael Planning Commission considered
the Draft North San Rafael Policy Plan in February and November
1983, continuing the matter for further revision; and
WHEREAS, during 1984 City and County staff revised
the Draft North San Rafael Policy Plan with consultation with
affected property owners; and
WHEREAS, a revised Draft North San Rafael Policy
Plan was distributed in January 1985 for public review, with
the Planning Commission considering the document draft Negative
Declaration prepared by County staff, correspondence, staff

reports and public testimony at meetings on January 29, 1985,
February 12, 1985, March 12, 1985, and March 26, 1985; and
WHEREAS, the San Rafael Planning Commission adopted
Resolution No. 85-8 recommending to the San Rafael City Council
certification of the Negative Declaration prepared by County
staff for the North San Rafael Policy Plan at such time as
the Council considers final action on the Plan, and that the
San Rafael City Council adopt a resolution of intent to amend
the San Rafael General Plan by adopting the North San Rafael
Policy Plan, more particularly described as the January 1985
Draft as revised consistent with Exhibit A of Planning Commission
Resolution No. 85-8; and
WHEREAS, the San Rafael City Council held a duly
noticed public hearing on April 15, 1985, at which time the
Council considered the April 1985 Draft North San Rafael Policy
Plan revised consistent with the aforementioned Planning Commission
resolution, the companion staff report and all public testimony
and correspondence; and
WHEREAS, the San Rafael City Council directed City
and County staff to provide additional information concerning
the North San Rafael Policy Plan which is contained in the
staff report for the May 6, 1985 City Council meeting and was
reviewed and considered by the Council on May 6, 1985.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council intends to certify the Negative Declaration prepared
by County staff and to amend the San Rafael General Plan by
adopting the North San Rafael Policy Plan as described in the
April 1985 revised draft as amended by Exhibit "A" to this
resolution of intent after the County Board of Supervisors
has reviewed and considered the Negative Declaration and draft
North San Rafael Policy Plan and the Board has resolved its
intent to amend the Marin Countywide Plan by adopting the North
San Rafael Policy Plan.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Monday , the 6th day of May ,
1985, by the following vote, to wit:

(6) Page III -11: insert to Policy B.1.3:
"During Phase II of the Hig-hwav 101 Corridor Plan and anv
Phase II of the North San Rafael Policv Plan. evaluate
extending the arterial roadwav roughly adjacent to the
NWP right-of-wav on the west side of the tracks north
to Hamilton Air Force Base."
(7) Page III -11: add Policy as follows:
"B.1.4 Off-site roadway improvements which may be required
to serve a proposed development should be the
responsibility of the project sponsor of the
property proposed for development."
(8) Page III -15, Policy C.1.2 revised to read:
"All major native oak groves and eucalyptus trees should
be preserved and maintained in a healthv condition."
(9) Page III -16: change last sentence of Policy C.1.3 to:
"A streamside protection corridor should be maintained
along the creek, within which development would be largely
prohibited consistent with the adapted eeuaty erdinanee
Policv B-1.3 of the Environmental Qualitv Element of the
Marin Countvwide Plan."
(10) Figure III -2: Modify legend to:
"City or County Designated Potential Open Space/Environmental
Protection Areas."
(11) Insert Tables 1 and 2 of County April 30, 1985 memorandum.
(12) Change residential designation of Daphne/Bacciocco property
to allow up to 146 residential units consistent with County
zoning and the Northgate Activity Center Plan and make
all appropriate resulting changes to tables and text.
EXHIBIT A
LIST OF CHANGES AND ADDITIONS TO THE
APRIL 1985 DRAFT NORTH SAN RAFAEL POLICY PLAN
AS APPROVED BY THE SAN RAFAEL CITY COUNCIL
ON MAY 6, 1985
(1) Insert Figure I-2 from April 30, 1985 County memorandum.
(2) Page III -1: Add Policy as follows:
"A.1.3 Preparation of a plan amendment for the Post -1990 -
Development (Urban Reserve) areas should begin
as soon as possible. Property owners should
be encouraged to contribute, in proportions
commensurate with anticipated benefit, to the
preparation of the plan amendment and to a Master
EIR/EIS which should accompany it."
(3) Page III -4, First paragraph, 4th sentence to read:
"By encouraging the development of job opportunities north
of San Rafael, the County might reduce the heavy traffic
movement in the County in the southbound direction during
the morning commute hours and in the northbound direction
in the evening."
(4) Page III -5. Policy A.3.2. Revised to read:
"Residential development proposed at all densities should
include below market rate units and some units accessible
to the handicaAAed."
(5) Pages III -9 and III -11, Policies B.1.1. and B.2.2 revised
to read:
"B.1.1 Level of Service "D" or better is recognized
as the operational standard for arterial and
collector streets and intersections in the North
San Rafael Area. In order to maintain this
level of service, all individual project reviews
shall incorporate appropriate analysis and conditions
of approval."
"B.2.2 The development of TSM programs should be encouraged
by setting the scale of permissible development
on the basis of vehicle trip generation. Permissible
development should onlv generate traffic volumes
which achieve Level of Service D* or better
at local intersections. Where TSM programs
can be shown to reduce trip generation, large
scale developments could be permitted."
