HomeMy WebLinkAboutCC Resolution 7007 (Second and Shaver Streets)RESOLUTION NO. 7007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ACCEPTING GRANT OF DRAINAGE EASEMENT ACROSS PORTION OF ASSESSOR'S PARCEL NO. 11-244-10, SAN RAFAEL, CALIFORNIA (Second and Shaver Streets) WHEREAS, public interest, convenience and welfare require that the easement hereinafter mentioned be accepted and used for the benefit of the public of the City of San Rafael, California; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of San Rafael, California, that that certain grant of easement for the maintenance, repair, reconstruction, and renewal of public drainage facility, executed by G. Paul and Catherine J. Leal to the City of San Rafael, dated December 28, 1984, be and the same is hereby accepted and the Clerk of said City is hereby di- rected to cause said conveyance to be duly recorded in the office of the County Recorder of the County of Marin, State of California, forthwith upon the adoption of this resolution. I, JEANNE M. LEONCINI, City Clerk 31111 17 N% �; K. '10°1 GRANT OF EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF STORM DRAIN G. Paul Leal and Catherine J. Leal, husban,? aff wife (hereinafter called "Grantor" without regard to number or gender) for an adequate consideration hereby GRANTS and conveys to the CITY OF SAN RAFAEL, a municipal corporation, an EASEMENT over the strip of land hereinafter described for the purpose of laying down, Installing, constructing, renewing, Inspecting, maintaining, repairing and using a public storm drain on or under said strip of land together with the right of Ingress thereto and egress therefrom, In, on and across said strip of land and the contiguous real property of Grantor. Said strip of land is located in the City of San Rafael, County of Marin. State of California, and is more particularly described a; follows: Per description attached hereto. Grantor shall not plant, place or deposit anything in or on said strip of land which will damage or interfere with any of the rights granted hereunder nor shall Grantor erect or construct any buildin• or other structure or drill or operate any well within said strip of land. The provisions hereof shall inure to the benefit of and bind the heirs, successors, and assigns of the respective parties hereto. My Commission Expifes: (Notary Public In and for said 1 �,�1 y 7 Count and State .�_ i DESCRIPTION All that certain Real Property situate in the City of San Rafael, County of Marin, State of California, described as follows: COMMENCING at a point on the Northerly line of Second Street (formerly the Northwestern Pacific Railroad Right of Way) which is distant 65.98 feet Westerly, along said Northerly line of Second Street, from its intersection with the Westerly line of Shaver Street; running thence Southeasterly along the arc of a circular curve to the left from a tangent which bears South 69° 23' 31" East, the radius of said curve being 544.50 feet for an arc distance of 26.00 feet to the TRUE POINT OF BEGINNING of this description; thence North 560 27' 56" East 39.00 feet, thence South 600 29' 16" East 19.00 feet to a point on the westerly line of Shaver Street, thence along the westerly line of said street South 230 42' 59" West 24.00 feet to the beginning of a curve to the right the center of which bears ' North 14° 31' 10" West and with a radius of 10.50 feet, along an arc length of 5.25 feet to a point of compound curvature, thence continuing on a curve to the right, the center of which bears North 14° 07' 42" East and with a radius of 544.50 feet, along an arc length of 35.58 feet to the TRUE POINT OF BEGINNING.
