A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL (IN ITS CAPACITY AS BOARD OF
APPEALS) GRANTING APPEAL FROM STATE ACCESS
REQUIREMENTS - 1050 NORTHGATE DRIVE
WHEREAS, the City Council of the City of San Rafael may serve as
a Board of Appeals pursuant to Health and Safety Code Section 19957.5 to
hear appeals from State mandated access requirements of said Code and of
the Government Code; and
WHEREAS, the applicant for 1050 NORTHGATE DRIVE has appealed
said access requirements before the City Council, acting as the Board
of Appeals; and
WHEREAS, following a noticed hearing in which said applicant was
given full opportunity to be heard, the City Council, acting as the
Board of appeals does hereby find as follows:
1) That the exception is requested for installation of accessible
toilet rooms.. on each floor of the building.
2) That the owner will provide accessible toilet rooms on the
ground floor of the building.
3) That the cost of providing accessible toilet rooms on all floors
is considerable, and would cause an unreasonable hardship.
4) That the handicapped community feels that installation of
accessible toilet rooms on the first floor only is acceptable.
5) That when the dollar amount of proposed improvements exceeds
the then current maximum for exceptions, further appeals board
action will be necessary.
6) That the determination of the valuation of any proposed work
will be made by the Building Official.
NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL,
ACTING IN ITS CAPACITY AS BOARD OF APPEALS, that in view of the foregoing
findings, the appeal for relief from access requirements for 1050 NORTH -
GATE DRIVE , be and is hereby granted.

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the Council of said City on
Monday , the 21st day of January 11 1985 , by the
following vote, to wit:
