RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DENYING APPEAL
AND UPHOLDING THE PLANNING COMMISSION APPROVAL OF
THE 424 MISSION ALCOHOL RECOVERY PROGRAM
WHEREAS, the Planning Commission approved an alcohol
recovery program for ten men on November 13, 1984, on the basis
that the use permit would not be detrimental to the neighborhood
or City in that conditions of approval insure adequate on-site
parking; similar Bay Area facilities have proven to be good
neighbors; and the City's share of such facilities would not
increase with the approval of this program; and
WHEREAS, on November 19, 1984, Hedwig Zaunmuller
appealed the Planning Commission decision on three grounds:
(1) That there is significant neighborhood opposition
to the program, and neighborhood opposition
was the reason for Planning Commission denial
of a similar use permit in Gerstle Park;
(2) That it is unfair to locate so many group care
facilities in one neighborhood; and
(3) That the proposed program would increase problems
with transients in the neighborhood; and
WHEREAS, the City Council considered the appeal at
a public hearing on December 17, 1984; and
WHEREAS, the Council found that the Gerstle Park
use permit was denied for reasons other than neighborhood opposition;
the number of group care facilities in the 424 Mission neighborhood
has recently declined; and there is no evidence that problems
with transients would be related to the proposed facility.
NOW, THEREFORE, BE IT RESOLVED that the Council denies
the appeal and upholds the Planning Commission approval of
the use permit for a ten person alcohol recovery program at
424 Mission with the following findings:
This use permit will not be detrimental to the
health, safety or general welfare of the neighborhood
or City in that conditions of approval insure that
on-site parking will be adequate; similar facilities

have proven to be good neighbors in other residential
neighborhoods throughout the Bay Area; the City's
and neighborhood's share of such facilities in the
County would not increase with the opening of 424
Mission; and there is no evidence that there could
be an increase in transient activity in the neighborhood
as a result of the proposed program.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Mondav , the 21st day of January ,
1985, by the following vote, to wit:
